Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim(s) 1-2, 4, 6-12, 25 is/are rejected under 35 U.S.C. 102 as being by RICO ALVARINO US 20170324528
1. A method for transmitting data, performed by a terminal, the method comprising: performing a data transmission within a target time unit in response to determining that there is a conflict between an uplink transmission scheduling and a downlink transmission scheduling within the target time unit (RICO ALVARINO: abstract - determines that the SRS would at least collide with the uplink transmission or the downlink transmission, and determines to adjust at least one of the uplink transmission, the SRS transmission, or reception of the downlink transmission based on the determination of the collision).

The method of claim 1, wherein performing the data transmission within the target time unit comprises: performing the data transmission within the target time unit based on an indication of a target transmission mode (RICO ALVARINO: fig. 12, unit 1232 [0127] The UE may apply the instructions received from the eNB).

The method of claim 1, further comprising: sending target indication information to a satellite in response to performing a downlink data reception within the target time unit, wherein the target indication information is configured to indicate that the terminal does not perform an uplink data transmission within the target time unit (RICO ALVARINO: fig. 12, unit 1202-1230 [0117, 0127] transmit a capability of the UE to an eNB at 1230 which may include, for example, an indication of its switching time and/or radio capabilities);
receiving a first resource for transmitting target uplink data allocated, based on the target indication information, by the satellite to the terminal (RICO ALVARINO: fig. 12, unit 1232 [0117, 0127] the UE may receive instructions regarding the transmission); and
transmitting the target uplink data to the satellite within a time unit included in the first resource (RICO ALVARINO: fig. 12 [0121-0123] the UE then performs at least one of transmitting the uplink transmission).

The method of claim 4, wherein the first resource comprises a plurality of time units, and wherein transmitting the target uplink data to the satellite within the time unit included in the first resource comprises: determining, based on a predefined manner, at least one first time unit from the plurality of time units included in the first resource; and transmitting the target uplink data to the satellite within the at least one first time unit (RICO ALVARINO: [0112] transmissions within the same subframe).
7. The method of claim 4, wherein the target uplink data comprises first uplink data that is not transmitted by the terminal within the target time unit; or the target uplink data comprises uplink data obtained by combining the first uplink data and second uplink data, wherein the second uplink data needs to be transmitted by the terminal within the time unit included in the first resource (RICO ALVARINO: [0117] excluding uplink portions of the first CC for data transmission).
8. The method of claim 1, further comprising: transmitting target indication information and target uplink data to a satellite within a time unit included in a second resource for performing uplink data transmission pre-allocated by the satellite to the terminal, in response to performing a downlink data reception within the target time unit, wherein the time unit included in the second resource is located after the target time unit, and the target indication information is configured to indicate that the terminal does not perform an uplink data transmission within the target time unit (RICO ALVARINO: [0117] excluding uplink portions of the first CC for data transmission).
9. The method of claim 8, wherein the second resource comprises a resource used by the terminal for performing a random access (RICO ALVARINO: [0126] PRACH).
10. The method of claim 8, wherein the second resource comprises a plurality of time units, and transmitting the target indication information and the target uplink data to the satellite within the time unit included in the second resource for performing the uplink data transmission pre-allocated by the satellite to the terminal comprises: determining, based on a predefined manner, at least one second time unit from the plurality of time units included in the second resource; and transmitting the target indication information and the target uplink data to the satellite within the at least one second time unit (RICO ALVARINO: [0063-0064, 0121] performs at least one of transmitting the uplink transmission on the second CC at 1212).
11. The method of claim 8, wherein the target uplink data comprises first uplink data that is not transmitted by the terminal within the target time unit; or the target uplink data comprises uplink data obtained by combining the first uplink data and second uplink data, wherein the second uplink data needs to be transmitted by the terminal within the time unit included in the second resource (RICO ALVARINO: [0117] excluding uplink portions of the first CC for data transmission).
12. The method of claim 11, wherein in response to the target uplink data comprising the uplink data obtained by combining the first uplink data and the second uplink data, the method further comprises: sending association information associated with the target uplink data to the satellite (RICO ALVARINO: fig. 15, unit 1504-1508 [0131-0132] plurality of SRS may be transmitted within one symbol).

Regarding claims 25, the independent claim and each dependent claim are related to the same limitation set for hereinabove in claims 1, where the difference used is a “terminal” with a processor and a memory (RICO ALVARINO: fig. 3, the wireless device 350 includes a processor 356, a memory 360) and the wordings of the claims were interchanged within the claim itself or some of the claims were presented as a combination of two or more previously presented limitations. This change does not affect the limitation of the above treated claims. Adding these phrases to the claims arid interchanging the wording did not introduce new limitations to these claims. Therefore, these claims were rejected for similar reasons as stated above.
Response to Arguments
Applicant's arguments filed on 4/22/26 have been fully considered but they are not persuasive.

Applicant respectfully elects Group I (claims 1-2, 4-, 6-12, 25) with traversal.
Response to Arguments:
With respect to the above argument, Examiner would like to draw attention to that
the Applicant’s traversal has been considered but it not persuasive. The elected Group I is directed to method related to a terminal node (e.g., user device), whereas non-elected Groups (claims 14-20, 26-27) is/are directed to method related to a satellite node which are totally distinct and related to separate function(s). Thus, for the above reason, the restriction requirement is maintained.
Remark:
The examiner stresses that the claims are too broad and require detail or specialization of the steps as recited in the claims. Alone and as claimed, the limitations are too open.
Examiner has cited particular portions of the references as applied to each claim limitation for the convenience of the applicant. Although the specified citations are representative of the teachings of the art and are applied to the specific limitations within the individual claim, other passages and figures may apply as well.
