Office Action

§103
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 103 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. Claim(s) 17-36 are rejected under 35 U.S.C. 103 as being unpatentable over Woochul et al (KR 2019 0139794). Woochul discloses Chemical Formula 1 (R1-R4 are hydrogen, deuterium, a substituted or unsubstituted aryl group, etc. A1-A4 May be hydrogen, deuterium, a substituted or unsubstituted aryl group, or the like; A5 is hydrogen or a heavy fraction; and is an integer of 0-5; b is an integer of 0-8; c is an integer of 0-3; Formula 1-1 (R1-R4 May be hydrogen, deuterium, a substituted or unsubstituted aryl group, or the like; A5 is hydrogen or a heavy fraction; A11 is a substituted or unsubstituted aryl group, and the like; and is an integer of 0-5; b is an integer of 0-8; and c is an integer of 0-3); and an organic electronic device including a first electrode, a second electrode provided to face the first electrode, and one or more organic material layers (a hole injection layer, a hole transport layer, an electron transport layer, an electron injection layer, and a light emitting layer) provided between the first electrode and the second electrode, wherein one or more layers of the organic material layers include the compound (see claims 1, 7, and 9-12). The compound of Chemical Formula 1-1 may include, for example, and the like (see claim 8), wherein, in Chemical Formula 1, R1-R10 and R12-R16 are hydrogen; L is a single bond; A1 is represented by Chemical Formula 2 [R17 is connected to anthracene of Chemical Formula 1, R18 (= A2) is a naphthyl group, and R19-R24 is hydrogen ]; and X is O. A compound of Chemical Formula 2 of claim 3 wherein A2 is a compound of Chemical Formula 3c. The compound of Chemical Formula 2, wherein A2 is a third structure. The compound represented by Chemical Formula 2, which has a fourth structure. The compound wherein R1-R10, R12-R16, and R19-R24 in Chemical Formula 5 are hydrogen; L is a single bond; and X is O. In Chemical Formula 12 of claim 9, R1-R8, R10, and R12-R16 are hydrogen; A1 is a compound represented by chemical formula 2 [R17 is connected to an anthracene of chemical formula 1, R18 (= A2) is a naphthyl group, and R19-R24 is hydrogen]; and in Chemical Formula 14 of claim 10, R1-R10 and R12-16 are hydrogen; L is a direct bond; and A1 is a compound in which Chemical Formula 2 [R17 is connected to anthracene of Chemical Formula 1, R18 (= A2) is a naphthyl group, and R19-R24 is hydrogen]. In Chemical Formula 17, R1-R10 and R12 are hydrogen; L is a direct bond; and A1 is represented by Chemical Formula 2 [R17 is connected to anthracene of Chemical Formula 1, R18 (= A2) is a naphthyl group, R19-R24 is hydrogen ], and X is O. Woochul further indicates that the compound of chemical formula 1 is included as a host of the light-emitting layer (see claim 13). The claims differ from Woochul in that at least one of R1-R8 of Chemical Formula 1 and one of R17-R24 of Chemical Formula 2 are aryl groups containing deuterium (difference 1), and in that a condensed ring including X in Chemical Formula 17 includes a phenyl group (difference 2). However, since R1 to R4 in Chemical Formula 1 are each independently hydrogen, deuterium, a substituted or unsubstituted aryl group, or the like, and A1 to A4 are hydrogen, deuterium, a substituted or unsubstituted aryl group, and the like, and A5 is hydrogen or deuterium (see claim 1), a person skilled in the art could readily derive differences 1 and 2 by appropriately changing the type of the substituent in chemical formula 1 disclosed in Woochul, and the effects thus achieved could also be sufficiently predicted by a person skilled in the art.
