Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim 8 rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Several of the claimed compounds appear to be the same. For instance Compounds 1, 4 and 7; Compounds 2, 5, and 8; Compounds 3, 6, and 9. The scope of the claim is unclear because it is unclear whether the compounds are intended to be different or not. Appropriate correction is required. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1-6 and 9-10 is/are rejected under 35 U.S.C. 102a1 as being anticipated by Tanaka et al (JP 2011173973 A). Tanaka discloses an OLED wherein the organic layer includes organic solvent deposited ink compositions [claims 1 and 4-9, [0159] comprising a host and a dopant wherein examples of the hosts include H-44 and H-48 which read on the PNG media_image1.png 103 270 media_image1.png Greyscale PNG media_image2.png 123 280 media_image2.png Greyscale [p35] and have molecular weight above 500. The composition is spin coated with the dopant in a toluene solvent at a ratio of 3:97 at a concentration of 2.0wt% [0223-0226]. Claim(s) 1-4 and 6-10 is/are rejected under 35 U.S.C. 102a1 as being anticipated by Lee et al (KR 20140043035). Lee discloses [claims 1-3, 0038-0053] an OLED comprising an organic layer with two dopants dissolved with a host material having the exemplified structure: PNG media_image3.png 132 101 media_image3.png Greyscale [p7 0042] which is the same as compound 1 of claim 8. The organic solution is spin coated in toluene to form the organic layer in the OLED, [Example 1, 0038-0053], the same solvent used in Applicant’s examples. The general formula of the host compound: PNG media_image4.png 177 186 media_image4.png Greyscale wherein R include deuterium or alkyl groups [claim 1].
