Office Action

§102
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claims 1-3, 5-7 and 9-22 are pending in this application. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claims 1-3, 5-7 and 10-21 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Li et al. WO 2022042591 A1 (equivalent to U.S. Pat. No. 11,807,635). Cited reference teaches the following compounds that are the same as applicants when applicant’s formula (II) has the following substituents: Ring AB = isoindole moiety PNG media_image1.png 108 115 media_image1.png Greyscale ; R1 = F; R2 = H or CH3; and R4 = R6 = H. PNG media_image2.png 59 493 media_image2.png Greyscale PNG media_image3.png 550 1531 media_image3.png Greyscale PNG media_image4.png 133 1486 media_image4.png Greyscale PNG media_image5.png 517 895 media_image5.png Greyscale PNG media_image6.png 581 1505 media_image6.png Greyscale PNG media_image7.png 640 1484 media_image7.png Greyscale Since the prior art compounds shown above are the same as applicants, a 102(a)(2) rejection is proper. Information Disclosure Statement 5. Applicant’s Information Disclosure Statement, filed on 10/15/2025, 04/02/2025, 12/16/2024 and 12/12/2023 has been acknowledged. Please refer to Applicant’s copies of the 1449 submitted herewith. Objection 6. Claims 9 and 22 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Conclusion 7. Any inquiry concerning this communication or earlier communications from the examiner should be directed to Kahsay Habte Ph.D. whose telephone number is (571)272-0667.
