The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1, 6, 7, 8, 9, 10, 14, 16, 18 and 19 is/are rejected under 35 U.S.C. 102 (a)(1) as being anticipated by Yamashita Keiko (JP 2015119802 A) (hereinafter Keiko).
Regarding claim 1, Keiko anticipates a coating device for coating a long member (30) for medial use, the coating device comprising a support part (80 and 70) capable of supporting the long member for medical use and a discharge port (94) which is provided in the support part or disposed at a higher location than the support part and from which liquid to be applied to the long member is discharged (Fig. 1, ¶0028).
Regarding claim 6, Keiko anticipates a pressing part (100) that presses the long member (30) downwardly (Fig. 3; ¶0037).
Regarding claim 7, Keiko anticipates the support part (80) is configured to be movable in a longitudinal axis direction of the long member so as to apply the liquid, which is supplied from the discharge port (94), to the long member (30), and the pressing part (100) is disposed forward of the discharge port in a direction in which the support art (80) advances in the longitudinal axis direction, and the pressing part presses the long member (30) toward the support part (70) (Fig. 3).
Regarding claim 8, Keiko anticipates the pressing part (100, 120, 130, 140) is configured to be movable in a vertical direction to press the long member (30) (Fig. 3; Fig. 7-10).
Regarding claim 9, Keiko anticipates the support part (80) is configured to be movable in a longitudinal axis direction of the long member (30), and the coating device further comprising comprises: an attachment part (99) that is connected to the support part (80), extends toward the side to which the support part advances, and attaches the pressing part (100) to the support part (80).
Regarding claim 10, Keiko anticipates a shaft (61) extending in a vertical direction, wherein the pressing part (100 the bottom roller) is disposed at a lower end portion of the shaft (Fig. Fig. 3).
Regarding claim 14, Keiko anticipates the discharge port (94) is configured to be movable in a longitudinal axis direction of the long member so as to apply the liquid to the long member (30) (Fig. 3).
Regarding claim 16, Keiko anticipates the discharge port (94) is configured to be moveable together with the support part (80) (Fig. 3).
Regarding claim 18, Keiko anticipates a first holding part (60) that holds a first end side in a longitudinal axis direction of the long member (30); and a second holding part (72) that holds a second end side in the longitudinal axis direction of the long member, wherein at least one of the first holding part and the second holding part has a rotation mechanism that rotates the long member (Fig. 3; ¶0028).
Regarding claim 19, Keiko anticipates the long member is a member for forming catheter (¶002).
Allowable Subject Matter
Claims 2-5, 11-13, 15 and 17 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
