Office Action

§112
DETAILED ACTION Claims 1-9 are presented for examination. The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-9 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Regarding claim 1 , from which the other claims depend or incorporate by reference, the limitation “ the general formula Na 1+x Ti 2 (PO 4 ) 3 (where 0≤x≤2) ” (emphasis added) does not have sufficient antecedent basis. Art of Record The following is a statement of reasons for the indication of allowable subject matter: none of the timely art of record teaches or suggests the claimed sodium titanium phosphate salt claim 1 with a composition and stoichiometric ratios represented by Na 1+x Ti 2 (PO 4 ) 3 (where 0≤x≤2), with the claimed surface layer with the specifically claimed composition and stoichiometric ratios represented by Na 5 Ti(PO 4 ) 3 . See also instant specification, at e.g. ¶¶ 0028, 31, 44, and 107-130. The closest art of record includes e.g. Yamashita et al (JP 2020/027733) and Quan et al ( CN 107732167 ).
