The following is a quotation of 35 U.S.C. 112 (pre-AIA), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. 07-34-01 Claims 1–18 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. 07-34-09 Regarding claim 1, the phrase "dome-like" renders the claim(s) indefinite because the claim(s) include(s) elements not actually disclosed (those encompassed by "-like"), thereby rendering the scope of the claim(s) unascertainable. See MPEP § 2173.05(d). Appropriate action is required. 07-34-08 Regarding claims 1, 14, & 18, the phrase "optionally" renders the claim indefinite because it is unclear whether the limitation(s) following the phrase are part of the claimed invention. Allowable Subject Matter 07-43-01 AIA Claim s 1–18 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), 2nd paragraph, set forth in this Office action. 13-03-01 AIA The following is a statement of reasons for the indication of allowable subject matter: the prior art does not appear to disclose or fairly suggest a burner having a fuel feed line and primary and secondary air feed lines, wherein the secondary air feed line is comprised of three concentric cylindrical tubes and protrudes into a hot gas zone, wherein the middle tube is closed off towards the outer zone and has overflow channels that open toward the outermost tube, wherein the outermost tube has adjustable swirl vanes, and wherein first and second dead volume exists between the secondary air feed line and the fuel feed line, in combination with the remaining claim elements .
