Office Action

§102 §Other
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim(s) 1-8 is/are rejected under 35 U.S.C. 102a2 as being anticipated by Choi et al (US 20230337533 A1). Choi discloses an OLED comprising a light emitting layer including a host compound [claims 1, 9-12] having the general and specific exemplified formulae below [abstract, p55,74]: PNG media_image1.png 192 314 media_image1.png Greyscale PNG media_image2.png 306 359 media_image2.png Greyscale PNG media_image3.png 288 307 media_image3.png Greyscale Wherein at least compound 1-50 [above, middle] anticipates the presently claimed Compound 1-49 in claim 5, under the genus of Chemical formula 1-8 of claim 4. Other anticipatory compounds include at least 1-49, 1-51, 1-52, and 1-57, see 3rd Party Submission of 03/31/2025 p6. Claim(s) 1-8 is/are rejected under 35 U.S.C. 102a2 as being anticipated by Choi et al (US 20230357209 A1). Choi discloses an OLED comprising a light emitting layer including a host compound [claims 1, 8] having the specific exemplified formulae below [abstract, pp241,244]: PNG media_image4.png 369 339 media_image4.png Greyscale PNG media_image5.png 301 370 media_image5.png Greyscale Wherein at least compound 2-109 anticipates the claimed compound 1-1 of claim 5. See 3rd Party Submission of 03/31/2025 p8 for additional anticipatory compounds. Other Relevant Prior Art US 20140070204 A1, listed as D04 on the Party Submission of 03/31/2025 corresponds the Comparative Compound Y3 of the instant specification: PNG media_image6.png 383 338 media_image6.png Greyscale . This compound does not fit within the scope of the claims because Ra and Rb on the first four Group II moieties do not include a phenyl (aryl) group: PNG media_image7.png 163 627 media_image7.png Greyscale . Applicant has shown improved Efficiency and Driving Voltage over compound [195] in the Specification, but any (possible) unexpected results are not commensurate in scope with the claims since only one inventive example is shown. Furthermore, the comparison of Example 1 to Comparative Examples 1 and 2 comprising Comparative Compound Y1 and Y2 does not reveal results that are unexpected. The inventive compound is more thoroughly deuterated than Compounds Y1 and Y2 (i.e. the compound is deuterated on the claimed bicarbazole core molecule as well as on the substituents Ar1 and Ar2), and the skilled artisan would expect improved results in the inventive compound containing higher deuteration rates.
