Election/Restriction
Claims 3-12 are withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to a nonelected group, there being no allowable generic or linking claim. Election was made without traverse in the reply filed on 7/29/2026.
Applicant’s election without traverse of Group I, claim 1-2 in the reply filed on 7/29/2026 is acknowledged.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim(s) 1-2 is/are rejected under 35 U.S.C. 102a1 and a2 as being anticipated by Bae (US Pub No. 2013/0017422)
Regarding Claim 1, Bae et al. teaches a battery pack assembly [10, Fig. 2, 0031] comprising: a battery pack [120, Fig. 2, 0042]; and a shock absorption member [110, 130, 140, 111 and 160, Fig. 2, 0031, 0034, 0045-0047] provided at one side of the battery pack [Fig. 2, 0031]].
Regarding Claim 2, Bae et al. is relied upon for the reasons given above, Bae et al. teaches wherein the shock absorption member comprises a polymer resin [0041, a portion of the shock absorption member comprises polymer synthetic resin, meeting the limitations of the claim] and an air pocket portion [See area encompassing 130 in figure 2, 111 are air flow holes, 0045, which let air flow into an air pocket area, Fig. 2]
