Office Action

§102
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1-3 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by JP 10-279800 Wakatake et al. Wakatake discloses a polyphenylene sulfide resin composition comprising: (A) 100 parts by weight of polyphenylene sulfide (0010), (B) 10-100 parts by weight of glass fibers having a B₂O₃ content of 1 wt% or less (0017), (C) 1-40 parts by weight of at least one selected from ethylenic polymers per 100 parts by weight of the PPS resin, that the preferable examples of the ethylenic copolymer include epoxy group-containing copolymers comprising ethylene and an epoxy-containing unsaturated compound other than ethylene (0021-0022), and (D) a releasing agent such as polyolefin such as polyethylene or polypropylene wax can be added to the polyphenylene sulfide resin composition (0025). The examples indicate that 100 parts by weight of a PPS resin, 8 parts by weight of a glycidyl methacrylate/ethylene copolymer, which reads on B-2 of claim 1, and 45 parts by weight of glass fibers (GF (1)) were blended to produce a resin composition (example 2). Here, referring to part 2 of table 1, the boron oxide content in the glass fibers (GF (1)) used in example 2 is 0 wt%. In addition, although the fluorine content in the glass fibers (GF (1)) is not clearly disclosed, since the total of the components indicated in part 2 of table 1 is 100, it is found that the glass fibers (GF (1)) do not contain components other than those recited in part 2 of table 1 and thus the fluorine content is considered to be 0 wt%. Thus, the glass fibers (GF (1)) used in example 2 satisfy the boron oxide content and the fluorine content in the glass fibers specified in claim 1. In addition, the blend ratios of the components in the resin composition disclosed in example 2 arc calculated as 65 (= 100/(100 + 8 + 45) X 100) wt% for the PPS resin, 5 (= 8/(100 + 8 + 45) X 100) wt% for GMA-PE, and 30 (= 45/(100 + 8 + 45) X 100) wt% for the glass fibers (GF (1)), which satisfy the blend ratios specified in claim 1. Claim(s) 1-3 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by JP 2016160396 Yamano et al et al. Yamano discloses a composition comprising: (in parathesis pbw converted wt% to match with the claims) 100 pbw (56.8-33.2 wt%) of polyarylene sulfide 5-30 pbw (2.8-9.6 wt%) of modified ethylene copolymer: -Ethylene-α, β-unsaturated carboxylic acid alkyl ester-maleic anhydride copolymer (B-1) manufactured by Arkema Co., Ltd. Product Name Bondine AX8390, -Ethylene-α, β-unsaturated carboxylic acid glycidyl ester-α, β-unsaturated carboxylic acid alkyl ester copolymer (B-2) Sumitomo Chemical Co., Ltd. (trade name) Bond First 7M. -Ethylene-α, β-unsaturated carboxylic acid glycidyl ester-vinyl acetate copolymer (B-3) manufactured by Sumitomo Chemical Co., Ltd. Product name Bond First 7B, -Ethylene-α, β-unsaturated carboxylic acid-glycidyl ester copolymer (B-4) manufactured by Sumitomo Chemical Co., Ltd. Bond First E , all of which are disclosed in the instant specification, 70-170 pbw (4-54.8 wt%) of glass fibers 1-10 pbw of a UV absorber 0.1-3 pbw of a mold release agent- fatty acid amide (Light Amide WH-255 same as is disclosed in the instant). Although Yamao doesn’t mention any boron oxide or F content, one would assume that none exist since it is not mentioned. Further, the current claims allows for both components to be 0 wt% in the present composition.
