DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Continued Examination Under 37 CFR 1.114 A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after final rejection. Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, the finality of the previous Office action has been withdrawn pursuant to 37 CFR 1.114. Applicant's submission filed on 03/12/2026 has been entered. Response to Amendment This office action is in reply to Applicant’s Response dated 03/12/2026. Claims 1, 9, 11, and 15 were amended. Claims 6 and 12 were canceled. Claim 21 was newly added. Claims 1-5, 7-11, and 13-21 remains pending in the application. Response to Arguments The applicant argues (see page 15 line 1 of the remarks) that “the Patent Office asserted that both the IAB node 10G and the IAB donor node 10A equate to the first communications node of the IAB or DU node. This seems to be illogic.” The examiner replies that to make the communication between the first communication node and other nodes clearer, a new reference is now used in conjunction with existing Harada. The new reference also addresses the applicant argument regarding the decision being based on redundant capacity in target backhaul path. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claims 1, 15, 20 and 21 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Talukdar et al. ( U.S. PGPUB 2022/040041), Talukdar hereinafter. Harada teaches all of the limitations of the specified claim with the following reasoning. Regarding claim 1, Talukdar teaches a rerouting method, comprising: obtaining, by a first communications node, target information, wherein the target information comprises: link state information of a backhaul path associated with the first communications node and ( [0058] FIG. 4 is a diagram illustrating IAB nodes reporting link capacity (e.g., child backhaul link capacity, or other link capacity) according to an indicated period or periodicity. Claim Rejections - 35 USC § 103 The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. In event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The factual inquiries set forth in Graham v. John Deere Co., 383 U.S. 1, 148 USPQ 459 (1966), that are applied for establishing a background for determining obviousness under 35 U.S.C. 103 are summarized as follows: 1. Determining the scope and contents of the prior art. 2. Ascertaining the differences between the prior art and the claims at issue. 3. Resolving the level of ordinary skill in the pertinent art. 4. Considering objective evidence present in the application indicating obviousness or nonobviousness. Claims 2-5, 7, 9, 11, 13, and 16-19 are rejected under 35 U.S.C. 103 as being unpatentable over Talukdar et al. (U.S. PGPUB 2022/0400411), Talukdar hereinafter, in view of Harada et al. (U.S. PGPUB 2021/0321297), Harada hereinafter. Regarding claim 2, Talukdar teaches Claim 1. Yet, Talukdar does not expressly teach wherein in a case that the link state information is downlink state information, the obtaining, by a first communications node, link state information of a backhaul path associated with the first communications node comprises: receiving, by the first communications node, second link state information reported by a downstream node in a downlink backhaul path, wherein the second link state information comprises at least one of the following: link state information obtained by the downstream node in the downlink backhaul path, and link state information reported by a downstream node of the downstream node in the downlink backhaul path. However, in the analogous art, Harada explicitly discloses 2.
