Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Responsive to amendments filed on 10/21/2025. Claims 1-9 were originally filed. Claims 1-2, 4-6, and 8-9 have been amended. Claims 10-15 have been newly added. Claims 1-15 remain pending. Response to Arguments Acknowledgement is made of the new title of the invention. Applicant’s amendments and remarks filed on 10/21/2025 have been fully considered, but they are not persuasive. With regards to the independent claims, which have been amended to recite elements of previously filed claim 2, namely: “the indication including a reason code indicating the second multi-link device avoid using the second link at the start time point”, the cited Patil reference is believed to meet this limitation. Paragraphs 0125-0127 (amongst others) disclose a first multi-link device (MLD) transmitting a frame to a second MLD including a Do Not Transmit (DNT) indication for the second MLD to avoid using a second link at the start time, as seen in figures 17B and 18, for example. As also seen in paragraphs 0257-0260, a DNT indication can be based on a channel switch announcement. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
