Office Action

§102
CTNF 18/329,818 CTNF 73915 DETAILED ACTION Notice of Pre-AIA or AIA Status 07-03-aia AIA 15-10-aia The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Election/Restrictions 08-25 AIA Applicant's election with traverse of Group I, claims 1-10 in the reply filed on 3/3/26 is acknowledged. The traversal is on the ground(s) that the different groups are not unrelated inventions . This is not found persuasive because the Group I claims are broader than the Group II or Group III claims, which are more detailed in the scope of their limitations . The requirement is still deemed proper and is therefore made FINAL. Claim Rejections - 35 USC § 102 07-06 AIA 15-10-15 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-12-aia AIA (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. 07-15-03-aia AIA Claim 1 is rejected under 35 U.S.C. 102(a)(2) as being anticipated by Quatro (US 2007/0139191) . Regarding claim 1, Quatro discloses a location management function center network element (paragraph 29, lines 3-4: “The location tracking system 100 comprises a central server 140; a plurality of remote locator tags 160 disposed on said objects, a plurality of remote repeater devices 180”), comprising: a processing device 260; and a memory to store instructions that, when executed by the processing device, cause the processing device to: determine location information of a relay node (paragraph 33, lines 3-4: “The position of the repeater devices 180 are referenced to a static known architectural point within the building structure 110”); obtain measurement information of a plurality of to-be-measured terminal devices (paragraph 35, lines 5-6: “The remote locater tags 160 reflect back the received signals from the repeater devices 180 at step 430.”); and determine location information of the plurality of to-be-measured terminal devices based on the location information of the relay node (paragraph 35, lines 11-12: “The tracking software then calculates the exact three dimensional location of the locater tag 160 based on frequency and direction of the locater tag 160”) . Allowable Subject Matter 12-151-08 AIA 07-43 12-51-08 Claim s 2-10 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. 13-03-01 AIA The following is a statement of reasons for the indication of allowable subject matter: the prior art fails to disclose the recited combination of elements, including send determining, based on the location capability feedback information, one of a plurality of terminal devices that have a sidelink-supporting capability in the plurality of terminal devices as the relay node; and determine all or some of a plurality of other terminal devices, other than the relay node, in the plurality of terminal devices that have the sidelink-supporting capability as the plurality of to-be-measured terminal devices, as in claim 2; causing the location management function center network element to: determine a radio access network device shared by the plurality of to-be-measured terminal devices as the relay node, as in claim 4; and sending a first request message to the relay node, wherein the first request message is used to request the relay node to report the measurement information of the plurality of to-be-measured terminal devices; and receive a first response message from the relay node, wherein the first response message comprises the measurement information of the plurality of to-be-measured terminal devices, as in claim 5 .
