Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claims 1, 8, and 10 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by YOH JAI ICK et al. (KR 20190128338 A). Regarding claim 1, Yoh discloses a needle free injector based on underwater discharge using shock wave, the needle free injector comprising: a pressure chamber 15 in which a driving fluid is stored; a medicine chamber 20 communicating with the pressure chamber to store medicine; a pressure transmitting unit 30 interposed between the pressure chamber and the medicine chamber to apply propulsion pressure to the medicine stored in the medicine chamber, when a volume of the pressure chamber is expanded; an injecting unit 22 provided at one side of the medicine chamber to discharge the medicine; and an electrode unit 200, 40a,40b to expand the volume of the pressure chamber, by generating bubbles in the driving fluid stored in the pressure chamber and causing break down. Regarding claim 8, Yoh further comprising: a driving fluid storage unit (within pump 300 and filter 400) to store a driving fluid; and a driving fluid circulating unit (recirculating system along 62,52) to circulate the driving fluid stored in the driving fluid storage unit and the driving fluid stored in the pressure chamber. Regarding claim 10, Yoh further comprising: a power unit 100 to supply pulsed power to the electrode unit, wherein the power unit includes: a power supply unit (not shown; a battery, power plug, etc.); an electricity storage unit diode 210 in the circuit board to store voltage and current supplied from the power supply unit in a form of electrical energy; and a switch Sw1, Sw2 to apply the electrical energy, which is stored in the electricity storage unit, in a form of pulsed power (these are not shown since Yoh set forth that these are well known). Allowable Subject Matter Claims 2-7, and 9 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
