Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Election/Restrictions
Applicant's election with traverse of group I invention in the reply filed on March 9, 2026 is acknowledged. In response to Applicant’s traversal is on the ground(s) that how the proposed process would from a fine crease structure as required in the claims, the crease is a result of different particle sizes in the layers. With regards to the restriction between groups I and III, the traversal is on the ground that a search for group I would have required in the search for group III. This is not found persuasive because the burden exists not only in searching but also in examination. Group III requires a search and examination of a product (mobile communication device) different from that of group I. The requirement is still deemed proper and is therefore made FINAL.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1, 3 and 4 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by KR-20200050249 (“KR’249”)
Claim 1: KR’249 teaches a heat dissipation sheet comprising a plurality of graphene oxide particle layers including at least two graphene oxide
particles having different average particle diameters (abstract and claims). KR’249 does not report the size of the crease between the plurality of graphene oxide particle layers; however, it is deemed that the crease size between the layers is within the claimed range because the crease size is a result of different particle sizes in the layers.
Claim 3: KR’249 shows a ratio of 50:50 for two different particle sizes (See paragraph 0056, Table 1, sample 1-1.
Claim 4: KR’249 shows the heat dissipation sheet having a thermal conductivity of at least 11,630 W/mK which is within the claimed range of at least 900W/mK.
Allowable Subject Matter
Claims 2 and 5-10 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Claims 17-20 will be rejoined for examination when all product claims are allowable. However, claims 11-19 will not be rejoined because they do not require all the allowable claim features.
The following is a statement of reasons for the indication of allowable subject matter: KR’249 fails to teach particles within the claimed ranges of claim 2 and fails to teach PAN particles in the heat dissipating sheet. None of the other prior art references of record teach a heat dissipating sheet comprising graphene oxide particles of different sizes in a layer of a plurality layers.
