DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Election/Restrictions
Applicant’s election without traverse of Group I, drawn to claims 1-14, in the reply filed on 01/22/2026 is acknowledged.
Claims 15-20 are withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to a nonelected invention, there being no allowable generic or linking claim. Election was made without traverse in the reply filed on 01/22/2026.
Information Disclosure Statement
The information disclosure statement (IDS) filed on 08/07/2023 is in compliance with the provisions of 37 CFR 1.97 and has been considered by the examiner. An initialed copy accompanies this Office Action.
Drawings
The drawings filed on 08/07/2023 have been considered.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-14 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
The term “high entropy” in claim 1 (line 1) is a relative term which renders the claim indefinite. The term “high entropy” is not defined by the claim, the specification does not provide a standard for ascertaining the requisite degree, and one of ordinary skill in the art would not be reasonably apprised of the scope of the invention. It is unclear as to what value or point of the hole entropy must be to be regarded as high entropy film. Appropriate correction and/or clarification is required.
Additionally, claim 1, at line 3, recites the limitation of “forming pores in polymer or a metal oxide resulting in a porous film”. It is uncleared whether the metal oxide can form a porous film as well. Appropriate correction and/or clarification is required.
Claims 2-14 directly or indirectly depends from claim 1 and are indefinite based on their dependencies.
It is noted that the term “high dielectric” in claim 1 (lines 1 and 6-7) is described as having a dielectric constant greater than 6 (See [0037] of the present specification).
Allowable Subject Matter
Claim 1 (and dependent claims 2-14) would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
The following is a statement of reasons for the indication of allowable subject matter: the closest prior art found is to US 2016/0027966 A1 (hereinafter Dubrow). Dubrow discloses a method of making a quantum dot enhancement film comprises porous material including a plurality of pores with quantum dots disposed within the plurality of pores (See Abstract and [0008]). The porous material includes UV-curable polymer and silicon dioxide (See [0048]).
Dubrow failed to disclose the method comprising a step of curing the conductive porous film resulting in a high dielectric swing heterogenous film (a film with dielectric constant greater than 6 as described in the present specification) as required in claim 1. Therefore, claim 1 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112 above. Claims 2-14 would be allowable based on their dependencies.
