Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Objections
Claim 1 is objected to because of the following informalities: Regarding claim 1, it appears that --- a trained neural networks --- at line 7, should have “s” deleted.
Appropriate correction is required.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 1-3, 5, 8-10, 12, 15-16 and 18 are rejected under 35 U.S.C. 102(a)(2) as being anticipated Mody et al. (US 2019/0327006 A1), hereinafter Mody.
Regarding claim 1, Mody discloses: (1) a system is configured to provide a portable spectrum analyzer that includes a signal analyzer for signal analysis, wherein the signal analyzer includes a deep neural network, see 0027, 0110, 0131, wherein the detected and identified signals including GSM, LTE, WiMax, ATSC-DTV, and WCDMA signals, see 0037; (2) a signal characterization window 10-fig.3 configured to display classification information, signal frequency, bandwidth, power, noise floor (an embedded co-channel anomalous signal), that has been determined by the signal analyzer. A power spectra density associated with one of the analyzed signals is configured to detect unknown signal (equivalent to a cover signal), see 0034, 0038, 0064, 0068-0069. Also, characteristics of the signal can be modified in the display, see 0036, 0114 (equivalent to receiving, at a receiver, a signal, the signal including a cover signal and an embedded co- channel anomalous signal; performing, at the receiver, signal processing on the signal to determine one or more characteristics of the signal; inputting, at the receiver, the one or more characteristics into a trained neural network; and receiving, as an output of the trained neural network, a classification of the signal, the classification identifying the cover signal and the embedded co-channel anomalous signal).
Regarding claim 2, the system of Mody includes a power spectral density, see 0034.
Regarding claim 3, one or more characteristics can be inputted into the signal analyzer that includes a neural network, see 0027, 0110, 0131.
Regarding claim 5, the detected unknown signal is part of ATSC-DTV signals, see 0037.
Regarding claim 8, this claim has similar limitations as those of claim 1. Therefore, it is rejected under Mody for the same reasons as set forth in the rejection of claim 1.
Regarding claim 9, the system of Mody includes a power spectral density, see 0034.
Regarding claim 10, one or more characteristics can be inputted into the signal analyzer that includes a neural network, see 0027, 0110, 0131.
Regarding claim 12, the detected unknown signal is part of ATSC-DTV signals, see 0037.
Regarding claim 15, this claim has similar limitations as those of claim 1. Therefore, it is rejected under Mody for the same reasons as set forth in the rejection of claim 1.
Regarding claim 16, the system of Mody includes a power spectral density, see 0034.
Regarding claim 18, the detected unknown signal is part of ATSC-DTV signals, see 0037.
Allowable subject matter
5. Claims 4, 6-7, 11, 13-14, 17 and 19-20 are rejected based on its dependency, would be allowable if rewritten or amended to include all of the limitations of the base claim and any intervening claims.
6. Claim 1 is objected, but would be allowable if claim 1 rewritten or amended to overcome the objection(s), set forth in this Office action.
Conclusion
7. The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Montavo (US 20210345120); Jeffords (US 2022/0345457)
are cited, and considered pertinent to the instant specification.
