The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claims 1-30 are pending in the application.
Claim Rejections - 35 USC § 112
3. The following is a quotation of 35 U.S.C. 112(b):
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
Claims 1-30 are rejected under 35 U.S.C. 112(b) as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor, regards as the invention.
The claimed features the combined, the pairs, each ballast conduit, the ballast conduits, their respective internal damping elements lack sufficient antecedent basis as recited in the claims (independent claims 1, 11, 18, 22 and 28, and subsequent dependent claims).
Regarding claims 1-27, the phrase "-type" renders the claim(s) indefinite because the claim(s) include(s) elements not actually disclosed (those encompassed by "-type"), thereby rendering the scope of the claim(s) unascertainable. See MPEP § 2173.05(d).
Allowable Subject Matter
Claims 1, 11, 18, 22 and 28 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b), set forth in this Office action.
Claims 2-10, 12-17, 19, 20, 23-27, 29 and 30 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b), set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.
Conclusion
9. The prior art cited and not relied upon is considered pertinent to applicant’s disclosure.
The prior art references cited by the examiner disclose wind turbine platforms including ballast.
