The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-6 is/are rejected under 35 U.S.C. 102a1 as being anticipated by Mogren (PGPub 20220167587).
Mogren teaches a paint brush cleaner device comprising: an upper section comprising an arbor (20), the arbor comprising an upper end opposing a lower end, wherein the arbor comprising a plurality of a series of rigid teeth (45; the term rigid is a relative term) integrally extending radially from the arbor; and a lower section comprising a shank (50) securely mounted to the lower end of the arbor.
With regards to claim 2, the arbor is solid.
With regards to claim 3, the plurality of the series of rigid teeth is oriented orthogonally to one another and uniformly spaced circumferentially about the arbor (figure 1; since the teeth are shown around the entire surface of the arbor, it is clear that there are teeth that are orthogonal to each other).
With regards to claim 4, the teeth of the plurality of the series of rigid teeth are uniformly sized (figure 5).
With regards to claim 5, the shank is received and securely held in a chuck and adjustable jaws of a commercially-available power drill (100; however the drill is not positively claimed).
With regards to claim 6, the shank is received and securely held in a collet of a commercially- available power drill (100; however the drill is not positively claimed).
Claim(s) 1-2, 4-6 is/are rejected under 35 U.S.C. 102a1 as being anticipated by Kramer (PGPub 20170099806).
Kramer teaches a paint brush cleaner device comprising: an upper section comprising an arbor (4), the arbor comprising an upper end opposing a lower end, wherein the arbor comprising a plurality of a series of rigid teeth (20; the term rigid is a relative term) integrally extending radially from the arbor; and a lower section comprising a shank (10) securely mounted to the lower end of the arbor.
With regards to claim 2, the arbor is solid.
With regards to claim 4, the teeth of the plurality of the series of rigid teeth are uniformly sized (figure 1).
With regards to claim 5, the shank is received and securely held in a chuck and adjustable jaws of a commercially-available power drill (28; however the drill is not positively claimed).
With regards to claim 6, the shank is received and securely held in a collet of a commercially- available power drill (28; however the drill is not positively claimed).
Claim(s) 7-12 is/are rejected under 35 U.S.C. 102a1 as being anticipated by Wachter (PGPub 20050172437).
Wachter teaches an upper section comprising an arbor (22), the arbor comprising an upper end opposing a lower end, wherein the arbor comprises a plurality of a series of rigid teeth (20; the term rigid is a relative term) extending transversely through the arbor; and a lower section comprising a shank (18) securely mounted to the lower end of the arbor.
With regards to claim 8, the arbor is solid.
With regard to claim 9, each of the series of rigid teeth is oriented orthogonally to one another in a staggered or overlapping fashion (figure 2; since the teeth are shown around the entire surface of the arbor, it is clear that there are teeth that are orthogonal to each other)., and wherein each of the series of rigid teeth is uniformly spaced circumferentially about the arbor.
With regards to claim 10, wherein the teeth of the plurality of the series of rigid teeth are uniformly sized (figure 2).
With regards to claim 11, the shank is received and securely held in a chuck and adjustable jaws of a commercially-available power drill (paragraph 0022; drill is not positively claimed).
With regards to claim 12, the shank is received and securely held in a collet of a commercially- available power drill (paragraph 0022; drill is not positively claimed).
