DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. Response to Amendment This Office Action is responsive to the amendment filed 02/24/2026 (“Amendment”). Claims 1-20 are currently under consideration. The Office acknowledges the amendments to claims 1, 10-12, 14-17, and 19. The objection(s) to the drawings, specification, and/or claims, the interpretation(s) under 35 USC 112(f), and/or the rejection(s) under 35 USC 101 and/or 35 USC 112 not reproduced below has/have been withdrawn in view of the corresponding amendments. Priority Acknowledgment is made of applicant's claim for foreign priority based on an application filed in Korea on 04/13/2021. It is noted, however, that applicant has not filed a certified copy of the KR10-2021-0047660 application as required by 37 CFR 1.55. Claim Objections Claim 19 is objected to because of the following informalities: the recitation of “obtain biometric signal” should instead read –obtain a biometric signal--. Appropriate correction is required. Specification The lengthy specification has not been checked to the extent necessary to determine the presence of all possible minor errors. Applicant’s cooperation is requested in correcting any errors of which applicant may become aware in the specification. Claim Interpretation The following is a quotation of 35 U.S.C. 112(f): (f) Element in Claim for a Combination. – An element in a claim for a combination may be expressed as a means or step for performing a specified function without the recital of structure, material, or acts in support thereof, and such claim shall be construed to cover the corresponding structure, material, or acts described in the specification and equivalents thereof. The following is a quotation of pre-AIA 35 U.S.C. 112, sixth paragraph: An element in a claim for a combination may be expressed as a means or step for performing a specified function without the recital of structure, material, or acts in support thereof, and such claim shall be construed to cover the corresponding structure, material, or acts described in the specification and equivalents thereof. The claims in this application are given their broadest reasonable interpretation using the plain meaning of the claim language in light of the specification as it would be understood by one of ordinary skill in the art. The broadest reasonable interpretation of a claim element (also commonly referred to as a claim limitation) is limited by the description in the specification when 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, is invoked. As explained in MPEP § 2181, subsection I, claim limitations that meet the following three-prong test will be interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph: (A) the claim limitation uses the term “means” or “step” or a term used as a substitute for “means” that is a generic placeholder (also called a nonce term or a non-structural term having no specific structural meaning) for performing the claimed function; (B) the term “means” or “step” or the generic placeholder is modified by functional language, typically, but not always linked by the transition word “for” (e.g., “means for”) or another linking word or phrase, such as “configured to” or “so that”; and (C) the term “means” or “step” or the generic placeholder is not modified by sufficient structure, material, or acts for performing the claimed function. Use of the word “means” (or “step”) in a claim with functional language creates a rebuttable presumption that the claim limitation is to be treated in accordance with 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph. The presumption that the claim limitation is interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, is rebutted when the claim limitation recites sufficient structure, material, or acts to entirely perform the recited function. Absence of the word “means” (or “step”) in a claim creates a rebuttable presumption that the claim limitation is not to be treated in accordance with 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph. The presumption that the claim limitation is not interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, is rebutted when the claim limitation recites function without reciting sufficient structure, material or acts to entirely perform the recited function. Claim limitations in this application that use the word “means” (or “step”) are being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, except as otherwise indicated in an Office action. Conversely, claim limitations in this application that do not use the word “means” (or “step”) are not being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, except as otherwise indicated in an Office action. This application includes one or more claim limitations that do not use the word “means,” but are nonetheless being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, because the claim limitation(s) uses a generic placeholder that is coupled with functional language without reciting sufficient structure to perform the recited function and the generic placeholder is not preceded by a structural modifier. Such claim limitation(s) is/are: “output device” in claims 1, 4, 5, 7, 9, 10, and 20, “light emitting unit” in claim 1, “light receiving unit” in claim 1, “fastening member” in claim 19, and “driving module” in claim 19. Because this/these claim limitation(s) is/are being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, it/they is/are being interpreted to cover the corresponding structure described in the specification as performing the claimed function, and equivalents thereof. If applicant does not intend to have this/these limitation(s) interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, applicant may: (1) amend the claim limitation(s) to avoid it/them being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph (e.g., by reciting sufficient structure to perform the claimed function); or (2) present a sufficient showing that the claim limitation(s) recite(s) sufficient structure to perform the claimed function so as to avoid it/them being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph. Claim Rejections - 35 USC § 112 The following is a quotation of the first paragraph of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112: The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention. Claims 1-18 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. Regarding claims 1 and 10, they describe identifying a variation amount of a DC component of the second PPG signal based on the first and second PPG signals. However, the specification describes identifying the variation amount during an occlusion operation (e.g. ¶ 154), i.e., based on two signals during occlusion, not one during occlusion and one pre-occlusion. Claims 1 and 10 contemplate the first signal as being pre-occlusion because the occlusion operation has not yet been conducted. Claims 2-9 and 11-18 are rejected because they depend on rejected claims. The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim 15 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Regarding claim 15, there is insufficient antecedent basis for the recitation of “the reference variation amount.” Claim Rejections - 35 USC § 101 35 U.S.C. 101 reads as follows: Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title. Claims 1-18 are rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more. Step 1 of the subject matter eligibility test (see MPEP 2106.03). Claims 1-9 are directed to a “device” and a “system,” which describe one of the four statutory categories of patentable subject matter, i.e., a machine. Claims 10-18 are directed to a “method,” which describes one of the four statutory categories of patentable subject matter, i.e., a process. Step 2A of the subject matter eligibility test (see MPEP 2106.04). Prong One: Claims 1 and 10 recite (“set forth” or “describe”) the abstract idea of a mental process and a mathematical concept, substantially as follows: obtaining a perfusion index based on a first PPG signal, identifying a variation amount of a DC component of the second PPG signal based on the first and second PPG signals, and measuring oxygen saturation by using the second PPG signal when the variation amount of the DC component exceeds a reference variation amount. The obtaining, identifying, and measuring steps can be practically performed in the human mind, with the aid of a pen and paper, but for performance on a generic computer, in a computer environment, or merely using the computer as a tool to perform the steps. If a person were to see a printout of the PPG signal(s), they would be able to derive/obtain a perfusion index, identify a variation amount, and measure oxygen saturation based thereon. There is nothing to suggest an undue level of complexity in the steps. Therefore, a person would be able to perform the steps mentally or with pen and paper. The obtaining, identifying, and measuring steps also involve the mathematical concepts of e.g. calculation, derivation, and comparison. These steps correspond to “[w]ords used in a claim operating on data to solve a problem [that] can serve the same purpose as a formula.” See MPEP 2106.04(a)(2)(I). Prong Two: Claims 1 and 10 do not include additional elements that integrate the mental process or mathematical concept into a practical application. Therefore, the claims are “directed to” the mental process or mathematical concept. The additional elements merely: recite the words “apply it” (or an equivalent) with the judicial exception, or include instructions to implement the abstract idea on a computer, or merely use the computer as a tool to perform the abstract idea (e.g. a processor), and add insignificant extra-solution activity (the pre-solution activity of: obtaining a first and second PPG signal using a generic data-gathering component (e.g. an electronic device including a biometric sensor having a light emitter and a light receiver); and the post-solution activity of: outputting guide information, using a generic data-outputting component (e.g. an output device), etc.). As a whole, the additional elements merely serve to gather and feed information to the abstract idea, while generically implementing it on a computer. There is no practical application because the abstract idea is not applied, relied on, or used in a meaningful way. No improvement to the technology is evident, and the guide information or instruction are not outputted in any way such that a diagnostic benefit is realized. Nobody need see, hear, or act on the information. Therefore, the additional elements, alone or in combination, do not integrate the abstract idea into a practical application. Step 2B of the subject matter eligibility test (see MPEP 2106.05). Claims 1 and 10 do not include additional elements, alone or in combination, that are sufficient to amount to significantly more than the judicial exception (i.e., an inventive concept) for the same reasons as described above. Dependent Claims The dependent claims merely further define the abstract idea and are, therefore, directed to an abstract idea for similar reasons: they merely further describe the abstract idea (e.g. measuring oxygen saturation from a different signal (claims 2 and 11), determining occlusion control information (claims 4 and 13), outputting based on a variation amount (claims 6, 8, 15, and 17), etc.), further describe the pre-solution activity (or the structure used for such activity) (e.g. obtaining an occluded PPG signal (claims 2, 3, 5, 7, 11, 12, 14, 16), etc.), and further describe the post-solution activity (e.g. outputting different information (claims 4, 5, 7, 9, 13, 14, 16, and 18), etc.). Taken alone and in combination, the additional elements do not integrate the judicial exception into a practical application at least because the abstract idea is not applied, relied on, or used in a meaningful way. They also do not add anything significantly more than the abstract idea. Their collective functions merely provide computer/electronic implementation and processing, and no additional elements beyond those of the abstract idea. Looking at the limitations as an ordered combination adds nothing that is not already present when looking at the elements individually. There is no indication that the combination of elements improves the functioning of a computer, output device, improves another technology or technical field, etc. Therefore, the claims are rejected as being directed to non-statutory subject matter. Allowable Subject Matter Claims 19 and 20 are allowable over the prior art. As allowable subject matter has been indicated, applicant's reply must either comply with all formal requirements (i.e., the claim objection) or specifically traverse each requirement not complied with. See 37 CFR 1.111(b) and MPEP § 707.07(a). The following is a statement of reasons for the indication of allowable subject matter: the prior art of record fails to teach or fairly suggest instructing the external device, which is coupled to a second part of the body that is different from the first part of the body where sensing occurs, to conduct an occlusion operation when the perfusion index corresponds to a second reference that is lower than the first index, in combination with all other recited limitations. Response to Arguments Applicant’s arguments filed 02/24/2026 have been fully considered. In response to the argument and amendments regarding the rejections under 35 USC 101, they are not persuasive. Applicant does not make any particular argument with respect to claims 1 and 10, and the Office disagrees that these claims “recite similar features” to claim 19. Claims 7 and 8 do not necessarily require changing an occlusion position – only outputting a certain kind of information. Visual or other information in claim 18 is also not “clearly patent eligible subject matter,” as nobody needs to see, hear, or act on the information. Applicant has not argued that the claims are directed to improvements to the functioning of a computer or other technology or technical field. I.e., the arguments are bare allegations of patentability. The amendments and arguments with respect to the rejections under 35 USC 103 are persuasive. Conclusion Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a). A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
