Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claims 1 – 4 are rejected under 35 U.S.C. 102(a)(1)/(a)(2) by Ito, US20180212233A1. Regarding claim 1, Ito teaches a positive electrode material [0002] comprising a positive electrode active material complex (A) and a sulfide solid electrolyte (B) [0004], wherein the positive electrode active material complex (A) (composite cathode material)[0050] has: a positive electrode active material (a)(core particle (101))[0052]; a conductive additive (b) covering at least a portion of a surface of the positive electrode active material (a) (coating layers)[0043][0056]; and a solid electrolyte (c) (sulfide solid electrolyte (300))[fig. 2] covering at least a portion of the conductive additive (b) (coatings (102)(103))[fig. 2], and the solid electrolyte (c) contains Li, Ti, X and F, and the X is at least one selected from the group consisting of Ca, Mg, Al, Y and Zr [0100][0101]. Regarding claim 2, the positive electrode material of claim 1, wherein the X contains Al [0100][0101]. Regarding claim 3, the positive electrode material of claim 1, wherein: the conductive additive (b) (coatings (102)(103)) covers an entire surface of the positive electrode active material (a) (core (101)), and the solid electrolyte (300)(c) covers an entirety of the conductive additive (b) [fig. 2]. Regarding claim 4, a solid-state battery [0004] comprising a positive electrode layer, a negative electrode layer, and a solid electrolyte layer disposed between the positive electrode layer and the negative electrode layer, wherein the positive electrode layer contains the positive electrode material of claim 1 [0022].
