DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Information Disclosure Statement
The information disclosure statement (IDS) submitted on 10/30/2023. The submission is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner.
Claim Objections
Claims 15-19 are objected to because of the following informalities:
Claims 15 and 19, the system of claim 14, but there is no claim 14 is the current set.
Claims 16-18 objected to under 37 CFR 1.75 as being a substantial duplicate of claims 10-12 and being depended upon claim 8. When the claims 10-12 and 16-18 in the application are duplicates or so close in content that they both cover the same thing, despite a slight difference in wording, it is proper after allowing one claim to object to the other as being a substantial duplicate of the allowed claim. See MPEP § 608.01(m).
Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-13 and 15-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as failing to set forth the subject matter which the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the applicant regards as the invention.
Claim 1 recites the term “high volume” in line 1 is a relative term which renders the claim indefinite. The term “high volume” is not defined by the claim, the specification does not provide a standard for ascertaining the requisite degree, and one of ordinary skill in the art would not be reasonably apprised of the scope of the invention.
Claims 8 and 13 recite the same term “high volume” in line 1 and they are rejected by the same reason as discussed in claim 1.
Claims 2-7, 9-12 and 15-20 are rejected as being dependent on, and failing to cure the deficiencies of, rejected independent claims 1, 8 and 13.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure:
Cohen (US20180317711A1) discloses an imprinting device designed to create images upon a variety of food products for decoration and/or marketing purposes, in particularly baked dough products such as flat bread or pitta.
