Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim(s) 1 is/are rejected under 35 U.S.C. 102(a)(2) as being clearly anticipated by Chen (US 2024/0068498). With respect to claim 1, Chen discloses a fastener 1, comprising: a bolt 10 including a head 100 and a threaded shank 101 including a bare section 1010 proximate the head, a threaded end section 102, an intermediate section 1012 proximate the threaded end section and having a spiral trough, and a threaded section 1011 between the intermediate section and the bare section; and a hollow member 11 including a head member 110 and a malleable shank 111 having a plurality of holes (1110, 1111, 1112). See particularly Figs. 3-6 and 8. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. US 2024/0084839 teaches a fastener includes a bolt including a head, a threaded shank having a bare section proximate the head, an intermediate grooved section, and an end section; and a hollow member including a head and a malleable shank having a plurality of holes through the shank. The grooved section includes a plurality of longitudinal grooves and a plurality of arcuate troughs between two of the adjacent grooves. The end section includes a plurality of projections arranged in a plurality of spaced, annular sets, and a plurality of cavities arranged in a plurality of spaced, annular sets. Each cavity is disposed between two of the adjacent projections. Each projection is disposed between two of the adjacent cavities. US 2007/0248432 teaches a blind fastener comprising a core bolt comprised of a bolt shaft and a bolt head. A metal sleeve is included comprising a rigid cylindrical base and a malleable cylindrical tail, the metal sleeve is positioned around the bolt shaft with the malleable cylindrical tail in communication with the bolt head. A travel stop feature is formed on the rigid cylindrical base opposite the malleable cylindrical tail. A drive feature includes a threaded bolt section extending from a foot end of the bolt shaft and a drive nut rotatably thereto. The drive nut allows the core bolt to be pulled within the metal sleeve such that the bolt head compresses the malleable cylindrical tail to form a retention button.
