Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim 9 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. In claim 9, “the other out-of-plane direction” lacks sufficient antecedent basis and renders the claim indefinite. Allowable Subject Matter Claims 1-8 and 10-20 are allowable. The following is a statement of reasons for the indication of allowable subject matter: The Examiner considers the closest prior art to be US 11,387,479 B2 (“Brett”). Brett discloses flow batteries with current collectors having a dielectric coating (title). Brett teaches first and second apertures are provided through the first current collector and the layer of dielectric material disposed on the second side of the first current collector to allow fluid to flow through the dielectric material and the current collector via the first aperture to the first electrode, along or through the electrode, and then out through the current collector and dielectric material through the first electrode (5:60-67). Brett teaches the layer of dielectric material may be adhered to the current collector by an adhesive layer (7:4-5). The flow battery may comprise a second reservoir comprising or for holding a second fluid electrolyte (9:36-49). Brett and other related prior art (for example, Lee et al. (US 2021/0175532 A1) fail to teach or fairly disclose a battery, as claimed in independent claims 1 and 17-20, comprising a first adhesive member that provides a binding between the first current collector and the frame, a second adhesive member that provides a binding between the second current collector and the frame, and an inter-electrode communication part configured to allow the first electrode reservoir and the second electrode reservoir to be in fluidic communication with each other (as in claims 1 and 17-19) or wherein the first and second adhesive member are disposed in a part of the space defined by the frame in which the first solid electrode and the second solid electrode are not disposed (as in claim 20), together in combination with the other limitations of the claims. Conclusion Any inquiry concerning this communication or earlier communications from the examiner should be directed to DANIEL H. LEE whose telephone number is (571)272-2548. The examiner can normally be reached M-F 8:30-5:00. Examiner interviews are available via telephone, in-person, and video conferencing using a USPTO supplied web-based collaboration tool.
