DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim 1 is rejected under 35 U.S.C. 102(as)(1) as being anticipated by Zhong et al. (CN 116517357, passages cited below refer to the machine-generated English translation provided with the instant office action).
Per claim 1, Zhong et al. teach a basket type filter assembly, comprising a filter basket (200), and a cover (220), wherein the filter basket is provided with a hinge portion on a side and a clamping portion on an opposite side (Fig. 6, 9, 10; page 3, Optionally, the filter basket comprises a basket and a cover body, one end of the cover body is hinged with the basket, and the other end of the cover body is buckled with the basket through a buckle mechanism.); the hinge portion is hinged with one side of the cover, an other side of the cover is configured for being clamped with a buckle (Fig. 6; 400; page 3, Optionally, the filter basket comprises a basket and a cover body, one end of the cover body is hinged with the basket, and the other end of the cover body is buckled with the basket through a buckle mechanism.; page 10, Specifically, in the embodiment, as shown in FIG. 9 and FIG. 10, the buckle mechanism 400 comprises a clamping groove 410 and a rotating arm 421, in both the cover body 220 and the basket 210, the clamping groove 410 is set in one of them, and the arm body of the rotating arm 421 is hinged to the other one, and the first end of the rotating arm 421 is provided with a clamping hook 422 matched with the clamping groove 410,), and the other side of the cover is pressed against the clamping portion (page 10, Here is a specific connection mode of the cover body 220 and the basket 210, when in use, the cover body 220 can be rotated to the position where the basket opening of the basket 210 is sealed, then the two are locked by the buckle mechanism 400, the cover body 220 and the basket 210 form an approximately sealed filtering space, In order to reduce the occurrence of secondary pollution of the water in the swimming pool caused by the impurity in the filter basket 200 escaping through the gap between the cover body 220 and the basket 210.).
Claims 1-2 are rejected under 35 U.S.C. 102(as)(1) as being anticipated by Deurloo (US 2017/0284077).
Per claim 1, Deurloo teaches a basket type filter assembly (101, 104; [0048] FIG. 1 illustrates a perspective view 100 of a CBFI and a corresponding adapter frame in accordance with one or more aspects of the disclosure. As shown, CBFI 101 includes a storm grate and lifting frame assembly 102 and a filter basket 104.), comprising a filter basket (104; As shown, CBFI 101 includes a storm grate and lifting frame assembly 102 and a filter basket 104.), and a cover (106; [0048] A storm grate hinge 110 attaches to the top of the CBFI 101 allows the hinged storm grate 106 to open and close relative to the lifting frame 108, which also includes a lifting frame hinge 112.; [0089] In accordance with one or more embodiments of the disclosure, a hinged storm grate fits atop a CBFI. The hinged stored grate may also be referred herein as a cover, a lid, or any non-limiting term that signifies a removable and/or hinged cover for a top of a container-like object.), wherein the filter basket is provided with a hinge portion (110; [0048] A storm grate hinge 110 attaches to the top of the CBFI 101 allows the hinged storm grate 106 to open and close relative to the lifting frame 108, which also includes a lifting frame hinge 112.) on a side and a clamping portion (connecting to 214) on an opposite side; the hinge portion is hinged with one side of the cover (Figs. 1,2), an other side of the cover is configured for being clamped with a buckle (214; [0051] As will be further discussed below, the CBFI 201 further includes a rotating element 208, which may be a power system or a flow meter, a sensor 210, a communication system 212, and a locking mechanism 214 arranged on the hinged storm grate or frame.), and the other side of the cover is pressed against the clamping portion (Fig. 1; [0089] The edges of the hinged storm grate rest on a lip on the inside dimension of the CBFI so it does not fall into the CBFI.).
Per claim 2, wherein the cover comprises a bottom, and a wall connected with the bottom, the bottom is provided with an edge on an outer side of the wall (Figs. 1-2, 6), and the edge is provided with rotating shafts (610; [0114] The hinge or pin may slide in a channel that allows the hinged storm grate to free itself from a restrictive opening.); the hinge portion is provided with shaft holes (608), and each of the rotating shafts is in rotatable fit with a corresponding one of the shaft holes ([0090] For example, FIG. 6 illustrates from a top view 600 a hinged storm grate 602 attached to the illustrated CBFI by way of a hinge pin 610 and a storm grate hinge barrel 612 fastened to the storm grate…The hinge pin 610 is positioned through both the lifting frame hinge barrel 608 and the storm grate hinge barrel 612 and can be fastened at both ends to hold the hinge pin inside the hinge barrels so the hinged storm grate is integrally connected to the lifting frame.).
Allowable Subject Matter
Claims 3-18 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
The following is a statement of reasons for the indication of allowable subject matter:
While claim 1 is not patentable for the reasons provided above, in the examiner’s opinion the prior art fails to teach or render obvious the assembly further comprising an assembly having elements with the recited positioning and operational elements as recited in claims 7-18.
While claim 2 is not patentable for the reasons provided above, in the examiner’s opinion the prior art fails to teach or render obvious the assembly further comprising an assembly having elements with the recited positioning and operational elements as recited in claims 3-6.
