DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis ( i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale , or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1 and 6 is/are rejected under 35 U.S.C. 102 (a)(1) as being anticipated by Guste [9316401] . With respect to claim 1, Guste discloses: An outdoor furnace table, comprising: a box body (10) formed with an installation channel, wherein a side end of the box body is provided with a heating hole (26) , an upper end of the box body is provided with a table plate, and the table plate is provided with a fire via port [ see FIG 5 reproduced below, col 2, line 53-col 3, line 4] ; an under-table heating portion comprising a first burner (45) at a lower end of the installation channel [col 5, line 45-61] ; a reflecting structure (40) provided in the installation channel to reflect a heat generated by the first burner to the heating hole for heating [see FIG 6 reproduced below , col 5, line 28-44 ]; a fire pan portion (72) comprising a second burner (57) located in the installation channel and above the first burner, wherein a fire generated by the second burner is transmitted through the fire via port (23) [see FIG 7] ; and a fuel supply system (54) provided in the installation channel and configured to supply a fuel to the first burner and the second burner [col 3, line 16-28] . Guste discloses: {cl. 6} The outdoor furnace table of claim 1, wherein the fuel supply system (54) comprises a plurality of valves (55) and a plurality of fuel supply pipes (38, 49, 50) , each of the fuel supply pipes is connected to the first burner or the second burner, and each of the fuel supply pipes is provided with the valve; and the valve is configured to control a delivery of the fuel to the first burner or the second burner [see FIG 9, col 4, line 19-35] . Claim Rejections - 35 USC § 103 The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. The factual inquiries for establishing a background for determining obviousness under 35 U.S.C. 103 are summarized as follows: 1. Determining the scope and contents of the prior art. 2. Ascertaining the differences between the prior art and the claims at issue. 3. Resolving the level of ordinary skill in the pertinent art. 4. Considering objective evidence present in the application indicating obviousness or nonobviousness. Claim (s) 2- 5 and 7- 8 is/are rejected under 35 U.S.C. 103 as being unpatentable over Guste [9316401], further in view of Sirand [5060629] . With respect to claims 2-5 and 7- 8, Guste discloses the invention as substantially claimed, however does not show the infrared burner. Sirand makes up for these deficiencies by teaching: {cl. 2} The outdoor furnace table of claim 1, wherein the first burner comprises an infrared burner [see abstract] . {cl. 3} The outdoor furnace table of claim 1, wherein the reflecting structure comprises a conical reflecting plate (1) , and four sides of a quadrangular pyramid are formed downward the conical reflecting plate [see FIG 2] . {cl. 4} The outdoor furnace table of claim 1, further comprising an air delivering system for supplying an air to the first burner and the second burner [col 5, line 17-22] . {cl. 5} The outdoor furnace table of claim 4, wherein the air delivering system comprises an air delivering pipe, and the air delivering pipe comprises a Venturi (4) ejecting tube [see FIG 2, col 5, line 17-22] . {cl. 7} The outdoor furnace table of claim 1, wherein a protective net (16) is sleeved on an outer periphery of the first burner [see FIG 2] . {cl. 8} The outdoor furnace table of claim 1, further comprising a thermocouple (18) provided above the first combustion and/or the second burner, wherein the fuel supply system comprises a fuel supply pipe, a solenoid valve (17) is provided on the fuel supply pipe [col 6, line 36-42] , and the thermocouple is connected to the solenoid valve [see FIG 2] . It would have been obvious to a person of ordinary skill in the art before the effective filing date of the invention to modify the invention of Guste by incorporating the burner of Sirand because Sirand provides a known arrangement that provides an effective heat output . Claim (s) 9-10 is/are rejected under 35 U.S.C. 103 as being unpatentable over Guste [9316401], further in view of Thomas [20080163863] . With respect to claims 9-10, Guste discloses the invention as substantially claimed, however does not show the further details of the glass fence. Thomas makes up for these deficiencies by teaching: {cl. 9} The outdoor furnace table of claim 1, wherein a glass fence is provided at the fire via port, and a burning medium is provided inside the glass fence [paragraph 0071] . {cl. 10} The outdoor furnace table of claim 9, wherein the burning medium comprises at least one of a glass stone (13) and a volcanic stone [see FIG 1, paragraph 0066]. It would have been obvious to a person of ordinary skill in the art before the effective filing date of the invention to modify the invention of Guste with the teachings of Thomas because Thomas provides a known arrangement of a gas fireplace that is effective at providing heat and aesthetically pleasing. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Bland et al [20080272109] is considered pertinent art with regard to similar teachings of a burner and reflective structure with a table portion [see FIG 5].
