DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Election/Restrictions Applicant's election with traverse of Group I in the reply filed on May 11, 2026 is acknowledged. The traversal is on the ground(s) that search and examination of all of the inventions can be conducted without serous burden. This is not found persuasive because Applicant’s assertion of non serious burden is unsupported by evidence. Additionally, while Groups I-III may have some common limitations, Groups I-III are patentably distinct for the reasons set forth in the Election/Restriction Requirement mailed on March 11, 2026. The requirement is still deemed proper and is therefore made FINAL. Claims 11-20 are withdrawn from further consideration pursuant to 37 CFR 1.142(b), as being drawn to a nonelected invention, there being no allowable generic or linking claim. Applicant timely traversed the restriction (election) requirement in the reply filed on May 11, 2026. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-10 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 1 recites the limitation “an autonomous vehicle” in lines 1-2. The claims fails to recite structure for “autonomous.” It is uncertain what constitutes “autonomous.” The structure recited by the claim is not commensurate in scope with the function “autonomous” of the vehicle. The claim further recites “a drive system,” but a drive system does not further distinguish “autonomous” because every vehicle has a drive system. The term “proximate” in claim 10 is a relative term which renders the claim indefinite. The term “proximate” is not defined by the claim, the specification does not provide a standard for ascertaining the requisite degree, and one of ordinary skill in the art would not be reasonably apprised of the scope of the invention. The distance/location limited by the claim is uncertain. The term “safest” in claim 10 is a relative term which renders the claim indefinite. The term “safest” is not defined by the claim, the specification does not provide a standard for ascertaining the requisite degree, and one of ordinary skill in the art would not be reasonably apprised of the scope of the invention. The condition limited by the claim is uncertain. What may be considered “safest” by one of ordinary skill in the art may not be considered “safest” by another of ordinary skill in the art.
