The abstract of the disclosure does not commence on a separate sheet in accordance with 37 CFR 1.52(b)(4) and 1.72(b). A new abstract of the disclosure is required and must be presented on a separate sheet, apart from any other text.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1-3 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Wasser.
Regarding claim 1, Wasser discloses that the use of a woodwind musical instrument tone hole cover piece (10) including adhesive material is conventional and well known in the art (column 1, lines 31) that can adhere to a tone hole (16) or tone hole chimney sufficient to form a closure seal of the tone hole (column 1, lines 24-28).
Regarding claim 2, Wasser discloses a device wherein the cover piece includes a rigid outer piece (column 2, line 1).
Regarding claim 3, Wasser discloses wherein the cover piece includes a flexible outer piece (column 1, lines 22 and line 65).
Claim 4 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
