The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Election
Applicant's election with traverse of Group I in the reply filed on 6.9/26 is acknowledged. The traversal is on the ground(s) that the method requires the apparatus of claim 13. This is not found persuasive because the method does not include the structure of claim 13.
The requirement is still deemed proper and is therefore made FINAL.
Claim Rejections - 35 USC § 112
Claims 1-12 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
As to claim 1, “the value compensable” (line 11) was never initially introduced. Should such read - - the compensable value - - . Is there some difference between “compensable value” and “value compensable”? They did appear to mean the same in light of the specification/drawings; but then, there may yet be a difference.
As to claim 1, “estimating a flow value for fuels of different compositions” (line 1) is confusing because the estimated “a flow value” is that of one composition. Note that the body of the claim refers to the preamble, and thus the preamble is an important part of defining the metes and bounds of the claim.
Prior Art
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
Masahiro et al WO 2014080723 teach (Figure 9) a method for estimating a flow value for fluid
Reference ‘036 (listed 1449) estimates a flow value by correcting for “dust attached”, by providing “corrected values” (line 39, p. 7) of “heat capacity” (line 39, p. 7), and employing such is subsequent measurements. However, the subsequent measurements are not compensated as a function of temperature or composition on the basis of a calibration characteristic curved saved for a reference gas per claim 1.
Comment 1449
As to the 1449, copies of 4 foreign references were not in the electronic record. As such, the 4 were crossed out on the 1449 and relisted on the 892 to get copies into the system. Such was the only way to get copies into the electronic record.
