Claim Objections
Claim 18 is objected to because of the following informalities: the preamble recites the method of “any one of claims 9”. Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 3-5 and 12 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
A broad range or limitation together with a narrow range or limitation that falls within the broad range or limitation (in the same claim) may be considered indefinite if the resulting claim does not clearly set forth the metes and bounds of the patent protection desired. See MPEP § 2173.05(c). In the present instance, claim 3 recites the broad recitation the second and third ligands are the same, and the claim also recites in particular the second and third ligands are fumaric acid or terephthalic acid, more particularly terephthalic acid, which is the narrower statement of the range/limitation. The claim(s) are considered indefinite because there is a question or doubt as to whether the feature introduced by such narrower language is (a) merely exemplary of the remainder of the claim, and therefore not required, or (b) a required feature of the claims.
Claim 4 recites the broader recitation, the first and second ligands are the same, and the claim also recites in particular the first and second ligands are fumaric acid or terephthalic acid, more particularly terephthalic acid, which is the narrower statement of the range/limitation.
Clam 5 recites the broad recitation, C2 to C10 linear or branched alkyl, and the claims also recites, in particular from ethyl, octyl, and 2-ethylhexyl, which is the narrower statement of the range/limitation.
Claim 12 recites the broad recitation, the metal component is a tetravalent metal selected from zirconium, titanium, cerium…, and the claim also recites, preferably wherein the metal organic framework is a zirconium metal organic framework or a zirconium-based metal organic framework further comprising hafnium, which is the narrower statement of the range/limitation.
Allowable Subject Matter
The following is a statement of reasons for the indication of allowable subject matter: claims 1, 2, 6-8, 9-11, 13-17, and 19-21 are drawn to a process for making a metal organic framework that is not taught or fairly suggested by prior art. Specifically, the prior art does not teach or suggest a process as claimed, wherein a first pre-ligand and at least one of a second pre-ligand or a first ligand are combined with a metal source.
