Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Election/Restrictions
Claims 2-3, 6-8, 10-11, 14-16 & 18-19 are withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to a nonelected Species A-B & D-F, there being no allowable generic or linking claim. Election was made without traverse in the reply filed on 7-9-26.
Applicant’s election without traverse of Species C of Claims 1, 4-5, 9, 12-13, 17 & 20 in the reply filed on 7-9-26 is acknowledged.
Priority
Applicant’s claim for the benefit of a prior-filed application, Provisional 63591405 filed 10-18-23, under 35 U.S.C. 119(e) or under 35 U.S.C. 120, 121, 365(c), or 386(c) is acknowledged.
Specification
The lengthy specification has not been checked to the extent necessary to determine the presence of all possible minor errors. Applicant’s cooperation is requested in correcting any errors of which applicant may become aware in the specification.
Drawings
The drawings were received on 1-17-24. These drawings are acceptable.
Claim Objections
Claim 9 is objected to because of the following informalities:
Claim 9, line 1,
“withdrawn” should be changed to ---original---
Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claims 1, 4-5, 17 & 20 are rejected under 35 U.S.C. 112(a) or pre-AIA 35 U.S.C. 112, first paragraph, as based on a disclosure which is not enabling. The disclosure does not enable one of ordinary skill in the art to practice the invention without “the memory 114 includes storage to store instructions executable by the processor 120”, ¶0018 & 114-Fig.1, see also ¶0031 & Fig.4, which is/are critical or essential to the practice of the invention but not included in the claim(s). See In re Mayhew, 527 F.2d 1229, 188 USPQ 356 (CCPA 1976). In this case, claims 1 & 17 require essential elements, e.g. a memory, coupled to the processor, storing executable instructions, when executed by the processor to perform its claimed functions {e.g. “to initiate association and to cause the front end to transmit”}.
-Claims 4-5 & 20 are also rejected in virtue of their dependencies on the independent claims 1 & 17, respectively.
Allowable Subject Matter
Claims 1-5, 17 & 20 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), 1st paragraph, set forth in this Office action.
Claims 9 & 12 are allowed.
Allowable Subject Matter
The following is a statement of reasons for the indication of allowable subject matter:
Regarding Claims 9 & 12.
The prior art fails to teach a method comprising:
initiating, via a front end of a wireless device, association of the wireless device with an anchor wireless device to communicate with the anchor wireless device; and
causing the front end to transmit, to the anchor wireless device, management frames comprising a plurality of bits that specify physical layer (PHY) capabilities, wherein the plurality of bits includes a particular bit that indicates whether the wireless device is an Internet-of-things (loT) device.
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
Cariou (US 2021/0329500 A1) discloses Logic to generate an extremely high throughput (EHT) physical layer protocol data unit (PPDU) comprising a medium access control (MAC) management frame. The MAC management frame comprising a QoS management field. the QoS management field comprising at least one bit value to indicate quality of service (QoS) management capability associated with links associated with more than one frequency bands. Logic to cause the transmission of the EHT PPDU. And logic to receive and decode the EHT PPDU {Figs. 1-8}.
Huang (US 2023/0239139 A1) discloses Logic for encryption and decryption of group addressed management. Logic to generate a management frame comprising a robust security network (RSN) element (RSNE), the management frame comprising a cipher suite field with a cipher suite used together with a set of one or more keys to encrypt the group addressed management frames. Logic to cause transmission of the management frame to one or more stations (STAs). Logic to receive a management frame comprising a robust security network (RSN) element (RSNE), the management frame comprising a cipher suite field with a cipher suite used together with a set of one or more keys to encrypt the group addressed management frames. And logic to decode the management frame to determine the cipher suite used together with the set of one or more keys for encryption of group addressed management frames {Figs.1-8}
Naik (US 20250113339 A1) discloses methods, components, devices, and systems for signaling for dynamic subchannel operation (DSO). Some aspects more specifically relate to indicating a set of subchannels supported for DSO. In some implementations, a wireless station (STA) may transmit a frame indicating subchannels supported for DSO (for example, for a specific link). An access point (AP) may receive the frame and may assign, using a control frame, one or more frequency resources of a subchannel of the set of subchannels to the STA for DSO. The STA may dynamically switch to the subchannel and may communicate via the subchannel while operating in a DSO mode. In some implementations, the STA may transmit capabilities information indicating that the STA supports the DSO mode. Additionally, or alternatively, the STA may dynamically enable or disable the DSO mode using action frames or aggregated-control (A-Control) subfields. The AP may support similar signaling {Figs.1-19}.
