DETAILED ACTION Notice of Pre-AIA or AIA Status The present application is being examined under the pre-AIA first to invent provisions. Applicant’s preliminary amendment filed 4/2/2024 is acknowledged and has been entered. Claims 1-33 have been canceled. Claims 34-53 is acknowledged. The amendment to the specification filed 4/2/2204 is acknowledged and has been entered. Priority This application is a CON of 17/094,908 filed 11/11/2020 which is a DIV of 15/843,957 filed 12/15/2017 now PAT 10,865,455 which is a DIV of 14/179,113 filed 02/12/2014 now PAT 9,868,997 which is a DIV of 13/028,589 filed 02/16/2011 now PAT 8,658,397 which claims benefit of 61/304,941 filed 02/16/2010. Information Disclosure Statement The information disclosure statement (IDS) submitted on 2/2/2024 is acknowledged. The submission is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. Drawings The drawings were received on 1/19/2024. These drawings are found acceptable by the Examiner. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 34-53 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. (a) Claims 34-53 are indefinite at the recitation of “at least preferential” and “preferentially anneal” because it implies the feature is optional and thus it is unclear whether the limitations following the phrase are part of the claimed invention. See MPEP § 2173.05(d). (b) Claims 34-53 is indefinite and confusing at the recitation of “if present” because it applies that the amplification steps is optional. However, neither the claims nor specification make clear how one is to perform the multiplex assay if the step of amplifying does not occur. Clarification required. Double Patenting 7. The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969). A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b). The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. Claims 34-53 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-11 of U.S. Patent No. 8658397 {US ‘397, used interchangeably herein}. An obviousness-type double patenting rejection is appropriate where the conflicting claims are not identical, but an examined application claim is not patentably distinct from the reference claim(s) because the examined claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F. 2d 887, 225 USPQ 645 (fed. Cir. 1985). Although the claims at issue are not identical, they are not patentably distinct from each other because both the claims 34-53 of the instant invention and the claims 1-11 of US ‘397 are directed to a multiplex assay for detecting the presence or absence of at least one serotype of human papillomavirus (HPV) in a biological sample comprising: providing a biological sample; contacting the biological sample with at least three oligonucleotide primer/probe sets, each of which comprises at least one oligonucleotide probe that is detectably labeled and has a nucleotide sequence length of about 10 to about 50 and at least two oligonucleotide primers each of which has a nucleotide sequence length of about 10 to about 150 under conditions such that the probes and primers anneal to a target sequence and wherein each primer/probe set is at least preferential for a specific serotype of an organism wherein the first and second primer/probe sets are degenerate with respect to each other and wherein the degenerate probes each have a signal moiety that emits signal that is detectable on the same channel and wherein the third primer/probe set is not degenerate with respect to the other two primer/probe sets and discriminates for a third serotype that is not the serotypes to which the degenerate primer/probe sets preferentially anneal and wherein the third primer/probe set has a signal moiety that emits signal at a wavelength that is the same or different from the wavelength emitted by the signal moiety of the degenerate probes; amplifying, if present, the target sequence; and monitoring for detection the label as an indication of the hybridization of the probe set to the target sequence thereby indicating the presence or absence of at least one of the serotypes of HPV (claim 1 of the instant invention and claim 1 of US patent ‘397). The claims 35-53 of the instant invention embodies the limitation of the claims 2-11 of US Patent ‘297. The claims 34-53 of the instant invention and the claims 1-11 only differs slightly in wording and clearly imbodies the limitations of each other. Thus, the claims 34-53 of the instant invention falls entirely within the scope of the claims 1-11 of US patent ‘397. As the court stated in In re Goodman, 29 USPQ2d 2010 (CAFC 1993), " a second application-- "containing a broader claim, more generical in its character than the specific claim in the prior patent"--typically cannot support an independent valid patent. Miller, 151, U.S. at 198; See Stanley, 214 F.2d at 153. Thus, the generic invention, as noted above is "anticipated" by the species of the patented invention. Cf., Titanium metal corp. v. Banner, 778 F.2d 775, 227 USPQ 773 (Fed. Cir. 1985) (holding that an earlier species disclosure in the prior art defeats any generic claims). This court's predecessor has held that, without a terminal disclaimer, the species claims preclude issuance of the generical application. "In re Van Ornum, 686 F.2d 937, 944, 214 USPQ 761, 767 (CCPA 1982); Schneller, 397 F.2d at 354". 9. Claims 34-53 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-16 of U.S. Patent No. 9868997 {US ‘997, used interchangeably herein}. An obviousness-type double patenting rejection is appropriate where the conflicting claims are not identical, but an examined application claim is not patentably distinct from the reference claim(s) because the examined claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F. 2d 887, 225 USPQ 645 (fed. Cir. 1985). The claims 34-53 of the instant invention embodies the limitation of the claims 1-16 of US Patent ‘997.The claims 34-53 of the instant invention and the claims 1-16 only differs slightly in wording and clearly imbodies the limitations of each other. Thus, the claims 34-53 of the instant invention falls entirely within the scope of the claims 1-16 of US patent ‘997. The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Jeney et al (US 20090215030, August 2009) teach a method of real time PCR using specially designed probes for the detection of multiple HPV serotypes (abstract and page 3). Jeney et al teach wherein the method detects multiple HPV serotypes specially designed primers for detecting desired serotypes having no straightforward rules in the literature (0048). Jeney et al however discuss that the different means for designing primers including those involving degenerate sequences (see col. 2 of page 4 and col. 1 of page 5). Jeney et al teach wherein the assay may involve the use of multiple probes and detectable labels for the detection of HPV serotypes (pages 7 and 8 and 0087-0088). Jenney et al do not teach describe two primer/probes that select from, but do not discriminate, between two different HPV serotypes. Rather Jenney teaches the use consensus primers and type specific primers in the amplification-based assay. Conclusion 12. No claims are allowed.
