Claim Objections
Claim 10 is objected to because of the following informalities: Line 1 of claim 10, the word “whereinthere” should be deleted and replaced with - - wherein there - -. Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claim 13 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 13 recites the limitation “and/or” which is indefinite as it is not clear what is or is not covered by the claim limitation.
Allowable Subject Matter
Claims 1-9, 11, 12 and 14-21 are allowed. The following is a statement of reasons for the indication of allowable subject matter: The prior art cited does not disclose a handling system with a disc-shaped container with packaging elements covered by a cover layer, and a gripping unit comprised of an adhesive arrangement, wherein the adhesive arrangement can be brought into a physical surface contact with a first side of the cover layer that faces away from the primary packaging elements.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
