Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Priority
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 1-16 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Zhou (CN215531587). An English machine translation of Zhou (CN215531587) is included with the Notice of Reference Cited (PTO-892).
With respect to the limitations of claim 1, Zhou teaches a vaporizer, comprising: a vaporization assembly (Figs 1-3, atomizer 10, 0034) comprising a first electrode contact and a second electrode contact (electrode contacts 111, 112, 0043); and an anti-counterfeiting assembly comprising a first electrode connection terminal (second electrode connection part 122, 0043) and a second electrode connection terminal (third electrode connection part 123), the first electrode contact (112) is connected to the first electrode connection terminal (122) to connect the vaporization assembly and the anti-counterfeiting assembly (anti-counterfeiting unit 21, 0043) in series, and the second electrode contact (111) comprises a first electrode (first ejector pin 131, 0043) of the vaporizer and the second electrode connection terminal (123) comprises a second electrode (second ejector pin 132, 0043) of the vaporizer such that upon connection of the vaporizer to a battery rod, the anti-counterfeiting assembly is configured to communicate with the battery rod through the first electrode and the second electrode (0022, 0036).
With respect to the limitations of claims 2, 3, 4, 5, 9, 10, 11 and 14, Zhou teaches the anti-counterfeiting assembly comprises: an anti-counterfeiting unit (21), respectively electrically connected to the first electrode connection terminal (122) and the second electrode connection terminal (123), and the anti-counterfeiting unit is configured to communicate with the battery rod to determine whether the battery rod matches the vaporizer (0005, anti-counterfeiting unit can communicate with the battery rod to determine whether the battery rod and the atomizer are compatible);
the first electrode connection terminal, the second electrode connection terminal, and the anti-counterfeiting unit are encapsulated into an independent element, or the first electrode connection terminal and the second electrode connection terminal (122, 123), and the anti-counterfeiting unit (21) are two elements independently arranged;
the anti-counterfeiting unit comprises a die (Fig 4, anti-counterfeiting chip MCU, 0037), or wherein the anti-counterfeiting unit comprises a die and an encapsulation body wrapping the die;
the anti-counterfeiting assembly comprises: a control unit comprising a communication detection end connected to the first electrode contact; and a power supply unit connected to the communication detection end and the control unit, and wherein, if the vaporizer is connected to the battery rod, after the vaporizer receives a communication signal from the battery rod through the communication detection end, the control unit is configured to send, through the communication detection end, a feedback signal to the battery rod based on a voltage signal provided by the power supply unit so as to implement communication between the vaporizer and the battery rod (Fig 4, 0037, 0038);
further comprising: a first ejector pin (first ejector pin 131, 0043); and a second ejector pin (second ejector pin 132, 0043), the first ejector pin is connected to the second electrode contact (111) to serve as the first electrode, and the second ejector pin is connected to the second electrode connection terminal (123) to serve as the second electrode;
the anti-counterfeiting assembly (21) is located between the second ejector pin (132) and the vaporization assembly (10)
the first electrode connection terminal and the second electrode connection terminal comprise bosses arranged on two opposite surfaces (first, second flange 133, 134, 0050) of the anti-counterfeiting unit (21), a first end of the first ejector pin (131) abuts against the second electrode contact (111), and a second end of the first ejector pin (131) is exposed from a vaporization base of the vaporizer to serve as a connecting end of the first electrode, and the first electrode connection terminal abuts against the first electrode contact (Figs 2,3), a first end of the second ejector pin (132) abuts against the second electrode connection terminal (123), and a second end of the second ejector pin is exposed from the vaporization base of the vaporizer to serve as a connecting end of the second electrode;
a vaporization base of the vaporizer is provided with a groove (Figs 1, 2, atomizing component 1, 0048), an opening of which faces outside, and the anti-counterfeiting assembly (21) is located in the groove (groove between pins 131, 132).
With respect to the limitations of claim 16, Zhou teaches an electronic vaporization device, comprising: the vaporizer of claim 1 (as set forth in the rejection of claim one above); and a battery rod, the vaporizer and the battery rod are connected to each other, and the battery rod is configured to supply power to the vaporizer (0021, 0038).
Claim 6-8, 12, 13 and 15 are also rejected because they are dependent upon claim 1.
Allowable Subject Matter
Claims 6-8, 12, 13 and 15 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
