The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1, 6, 14, 15 and 20 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Koike (4,069,617).
Koike discloses a vehicle window assembly comprising a glass plate 16; a guide rail 20 defining an accommodating space (see Figure 3), wherein the accommodating space has an opening facing the glass plate 16; a mounting member 22, wherein at least part of the mounting member is disposed in the accommodating space, the mounting member 22 defines a mounting hole (via aperture holding 24), and the mounting hole is in communication with the accommodating space; and a connecting member 24, wherein the connecting member 24 has one end connected to the glass plate, and the other end penetrating through the mounting hole. The vehicle window assembly comprises a limiting member disposed on a sidewall of the accommodating space, the limiting member is disposed in a direction parallel to an extension direction of the guide rail 20, the mounting member 22 defines a first limiting groove at a peripheral side end of the mounting member close to the sidewall, the first limiting groove 22a is corresponding to the limiting member, and at least part of the limiting member is disposed in the first limiting groove (see Figure 3). Two ends of the mounting member 22 at one side of the mounting member close to a bottom wall of the accommodating space are chamfered (see Figure 3).
Koike discloses a vehicle comprising a door 10, wherein the door comprises a door body and a vehicle window assembly, and the vehicle window assembly is disposed on the door body; wherein the vehicle window assembly comprises a glass plate 16; a guide rail 20 defining an accommodating space (see Figure 3), wherein the accommodating space has an opening facing the glass plate; a mounting member 22, wherein at least part of the mounting member is disposed in the accommodating space, the mounting member defines a mounting hole (via aperture holding 24), and the mounting hole is in communication with the accommodating space; and a connecting member 24, wherein the connecting member has one end connected to the glass plate, and the other end penetrating through the mounting hole. The vehicle window assembly comprises a limiting member disposed on a sidewall of the accommodating space, the limiting member is disposed in a direction parallel to an extension direction of the guide rail, the mounting member 22 defines a first limiting groove at a peripheral side end of the mounting member close to the sidewall, the first limiting groove 22a is corresponding to the limiting member, and at least part of the limiting member is disposed in the first limiting groove (as shown in Figure 3).
Allowable Subject Matter
Claims 2-5, 7-13, and 16-19 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. The prior art recited discloses common inventive concepts as the claimed present invention.
