Office Action

§103
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 103 The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. This application currently names joint inventors. In considering patentability of the claims the examiner presumes that the subject matter of the various claims was commonly owned as of the effective filing date of the claimed invention(s) absent any evidence to the contrary. Applicant is advised of the obligation under 37 CFR 1.56 to point out the inventor and effective filing dates of each claim that was not commonly owned as of the effective filing date of the later invention in order for the examiner to consider the applicability of 35 U.S.C. 102(b)(2)(C) for any potential 35 U.S.C. 102(a)(2) prior art against the later invention. Claim(s) 1, 11-12 and 29 is/are rejected under 35 U.S.C. 103 as being unpatentable over Zhang (US 2026/0189970) in view of Hosseini (US 2022/0110058). Zhang discloses the following features. Regarding claim 1, an apparatus (see Terminal device in Fig. 11) configured for wireless communications, comprising: one or more memories comprising processor-executable instructions (see “memory” recited in paragraph [0804]); and one or more processors (see “processor” recited in paragraph [0804]) configured to execute the processor-executable instructions and cause the apparatus to: transmit, to a network entity, a DSR report (see Fig. 11, wherein the terminal device transmits a status report in step S611 to a network device; wherein “the status report may be a DSR” as shown in paragraph [0382]) comprising: one or more fields indicating whether or not delay information is present in the DSR for one or more LCGs (see DSR data structure shown in Fig. 3b, wherein the delay index “indicates whether there is a data amount of data of the LCG in a corresponding time interval” according to paragraph [0216]); and delay information for at least one LCG of the one or more LCGs for which the one or more fields indicate delay information is present in the DSR, the at least one LCG comprising a first LCG (see “For example, each LCG in the MAC CE corresponds to a table index field, a delay information indication field, and a buffer size field…The delay information indication field indicates a remaining transmission delay budget” recited in paragraph [0219]). The base station apparatus 20 may transmit, to the terminal apparatus 10, DCI including information indicating the first threshold Th1” recited in paragraph [0207]). It would have been obvious to one of ordinary skill in the art at the effective filing date of the current Application to modify the system of Zhang, Jin and Hosseini using features, as taught by Nagano, in order to determine urgent data that needs to be transmitted immediately (see paragraph [0207], abstract of Nagano). Claim(s) 27-28 is/are rejected under 35 U.S.C. 103 as being unpatentable over Zhang, Jin and Hosseini as applied to claim 25 above, and further in view of Lai. Zhang, Jin and Hosseini disclose the features as shown above. Zhang does not disclose the following features: Regarding claim 27, wherein the one or more processors are configured to execute the processor-executable instructions and cause the apparatus to transmit, to the UE, a PDCCH adaptation indication indicating to stop monitoring the one or more PDCCH monitoring occasions; Regarding claim 28, the PDCCH adaptation indication comprises a PDCCH skipping command for a time period; and the one or more PDCCH monitoring occasions are scheduled during the time period. Lai discloses the following features. Regarding claim 27, wherein the one or more processors are configured to execute the processor-executable instructions and cause the apparatus to transmit, to the UE, a PDCCH adaptation indication indicating to stop monitoring the one or more PDCCH monitoring occasions (see Fig. 5 and paragraph [0081], wherein “The UE may receive a PDCCH skipping indication (containing/carrying a specific DCI format) from the NW. The PDCCH skipping may be used to indicate a duration that the UE may need to stop monitoring PDCCH”). Regarding claim 28, the PDCCH adaptation indication comprises a PDCCH skipping command for a time period; and the one or more PDCCH monitoring occasions are scheduled during the time period (see Fig. 5 and paragraph [0081], wherein “The UE may receive a PDCCH skipping indication (containing/carrying a specific DCI format) from the NW. The PDCCH skipping may be used to indicate a duration that the UE may need to stop monitoring PDCCH”, wherein Fig. 5 shows such duration/occasions during which PDCCH monitoring is stopped). It would have been obvious to one of ordinary skill in the art at the effective filing date of the current Application to modify the system of Zhang, Jin and Hosseini using features, as taught by Lai, in order to allow the UE to enhance power saving by allowing dynamic switching between sparse and frequent PDCCH monitoring (see paragraphs [0075]-[0076] of Lai). Allowable Subject Matter Claim 13 and 26 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
