Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 21 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Kalinowski (US 11714285).
Regarding claim 21 Kalinowski teaches a securement arm (fig. 11), comprising:
a housing (fig.11, 20);
a first electronic component (fig.11, 80);
a second electronic (fig.11, 92) component separate from the first electronic component (fig.11, 80) by a variable length connector (fig.11, fig. 12, shows capability of being variable length of arm i.e. element 36+ element 38, 290); and
an electrical wire (fig.11, wires 210) extending through the extendable length connector (fig.11, fig. 12 shows capability of being stretched) between the first electronic component (fig.11, fig. 12, 80) and the second electronic component (fig.11, fig. 12, 92).
Allowable Subject Matter
Claims 1-15, 17, 18 are allowed.
Response to Arguments
Applicant's arguments filed 9/21/26 have been fully considered but they are not persuasive.
Applicant argues: Kalinowski fail to teach “a second electronic component separate from the first electronic component by a variable length connector”.
Examiner responds: The Examiner respectfully disagrees. Kalinowski teaches a second electronic (fig.11, 92) component separate from the first electronic component (fig.11, 80) by a variable length connector (fig.11, fig. 12, shows capability of being variable length of arm i.e. element 36+ element 38, 290); See below that the effective length of the securement arm marked by red arrow changed. As the claim is broad and does not describe how variability occurs. Therefore, the Examiner maintains the rejection.
