Office Action

§102 §103
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Priority Acknowledgment is made of applicant's claim for foreign priority based on application no. PCT/CN2021/113222 filed in China (under the PCT) on 08/18/2021. It is noted that the applicant has filed a certified copy of the application as required by 37 CFR 1.55. Information Disclosure Statement The information disclosure statements (IDSs) submitted on 02/08/2024 and 09/18/2025 comply with the provisions of 37 CFR 1.97. Accordingly, the IDSs are being considered by the examiner. Specification The title of the invention is not descriptive. A new title is required that is clearly indicative of the invention to which the claims are directed (see MPEP 606.01). Claim Objections Claims 12, 17, 18 and 19 are objected to because of the following informalities: Claim 12 (line 1) recites “a fourth indication information”. However, there is not a preceding third indication information recited in claims after the “first indication information” and “second indication information” limitations introduced in Claims 5 and 6 respectively. Therefore, “a fourth indication information” should read - - a third indication information - - for consistency of applicant’s claim drafting. Claim 17 (line 2) recites “a fifth time unit”. However, there is not a preceding third time unit or fourth time unit fourth time unit or second time unit introduced in the claims. Therefore, “a fifth time unit” should read - - a third time unit- - for consistency of applicant’s claim drafting (e.g. Claim 15, to which Claim 17 depends). Independent Claims 18 and 19 recite a machine claim, “A first terminal device / second terminal device . . .” and a list of devices (i.e. a processor, memory) in the preamble. However, the body of the claim recites the action steps: “transmitting, receiving, , . “. Accordingly, for clarity and placing the claims in proper machine claim form, Claim 18 preamble “ A first terminal device, comprising a processor . . .” should read - - A first terminal device, comprising: a processor . . . - - - and Claim 19, preamble “ A second terminal device, comprising a processor . . .” should read - - A second terminal device, comprising: a processor . . . (see MPEP 2106.03, section I1 ; MPEP 2173.05(p), section II2). Appropriate correction is required. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. [and] a plurality of such memories may be included in the electronic device; see also Claim 8 first UE comprising a transceiver, and at least one processor). Claim Rejections - 35 USC § 103 The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. The factual inquiries for establishing a background for determining obviousness under 35 U.S.C. 103 are summarized as follows: 1. Determining the scope and contents of the prior art. 2. Ascertaining the differences between the prior art and the claims at issue. 3. Resolving the level of ordinary skill in the pertinent art. 4. Considering objective evidence present in the application indicating obviousness or non-obviousness. This application currently names joint inventors. In considering patentability of the claims the examiner presumes that the subject matter of the various claims was commonly owned as of the effective filing date of the claimed invention(s) absent any evidence to the contrary. Applicant is advised of the obligation under 37 CFR 1.56 to point out the inventor and effective filing dates of each claim that was not commonly owned as of the effective filing date of the later invention in order for the examiner to consider the applicability of 35 U.S.C. 102(b)(2)(C) for any potential 35 U.S.C. 102(a)(2) prior art against the later invention. Claim 8 is rejected under 35 U.S.C. 103 as being unpatentable over SHIN, as cited in Claim 1 above, in view of JIAO et al. (US 20230118141 A1): hereinafter JIAO. Regarding Claim 8, SHIN teaches Claim 1. SHIN further teaches [in condition of] the first terminal device transmitting a CSI-RS to the second terminal device through a corresponding spatial domain transmission filter (SHIN, FIG. 10A, ¶0193 at 1001 a transmitting UE (UE1) may transmit a periodic sidelink channel state information reference signal (SL CSI-RS); [and] FIG. 10B, ¶0199 configuring multiple SL CSI-RS resources and transmitting the respective SL CSI-RS resources through different beams). SHIN does not explicitly teach in condition of the first terminal device transmitting a CSI-RS to the second terminal device through a corresponding spatial domain transmission filter, carrying, by the first terminal device, a CSI-RS resource indication information corresponding to the CSI-RS in a sidelink control information (SCI) associated with the CSI-RS. However, in the analogous art, JIAO discloses in condition of the first terminal device transmitting a CSI-RS to the second terminal device through a corresponding spatial domain transmission filter, (JIAO, ¶0088, [t]he beam is embodied as a spatial domain filter (spatial domain filter); A beam used to send a signal is referred to as a transmission beam (transmission beam, Tx beam) ¶0157, in response to the first RS being an SL CSI-RS, transmitting end UE configures an SL CSI-RS pattern (pattern), and sends first indication information to the receiving end UE; ¶0170 at 1001 transmitting end UE sends, to the receiving end UE, the RS for panel selection); carrying, by the first terminal device, a CSI-RS resource indication information corresponding to the CSI-RS in a sidelink control information (SCI) associated with the CSI-RS (JIAO, ¶0157, the indication information indicates an SL TCI identifier of a first SL CSI-RS, the first indication information is carried in M bits in second-stage SCI, [and] FIG. 9, ¶0155, at S902, the indication information indicates an SL TCI identifier of a first SL CSI-RS, the first indication information is carried in M bits in second-stage SCI, at S903, the transmitting end UE sends the first RS to the receiving end UE; see also ¶0082, [t]he PSSCH carries sidelink data (SL data), the PSCCH carries sidelink control information (sidelink control information, SCI), and the SCI is also referred to as a sidelink scheduling assignment (sidelink scheduling assignment, SL SA)). Therefore, it would have been obvious to one of the ordinary skill in the art before the effective filling date of the claimed invention to combine SHIN’s apparatus and a method for a side link beam operation in a wireless communication system with JIAO’s SL communication method. The motivation would be to improve communication reliability and selection efficiency [JIAO, 2, ¶0096; ¶0197]. Claim 11 is rejected under 35 U.S.C. 103 as being unpatentable over SHIN, as cited in Claim 1 above, in view of KANG et al. (US 20200127723 A1): hereinafter KANG. Regarding Claim 11, SHIN teaches Claim 10. SHIN further teaches the N CSI-RS resources comprise N1 first-class CSI-RS resources and N2 second-class CSI-RS resources; wherein the N1 first-class CSI-RS resources correspond to CSI-RSs received by the second terminal device ( (SHIN, FIG. 10B, ¶0199, configuring multiple SL CSI-RS resources and transmitting the respective SL CSI-RS resources through different beams; ¶0200 [t]he receiving UE (UE2) may measure reception reference signal received power (RSRP) for different beams transmitted by the transmitting UE (UE1), so as to find the best transmission beam/”N1”/”first class” . . . a method of reporting the measured RSRP value for the best beam and reporting a differential RSRP value for the remaining beams may be considered/”N2”/”second class”); or the N1 first-class CSI-RS resources correspond to CSI-RSs received by the second terminal device and with the corresponding measurement results that are each greater than or equal to a first threshold value; SHIN does not explicitly teach indexes corresponding to the N2 second-class CSI-RS resources are determined by at least one CSI-RS resource of the N1 first-class CSI-RS resources, or indexes corresponding to the N2 second-class CSI-RS resources are determined by at least one CSI-RS resource of the plurality of CSI-RS resources other than the N1 first-class CSI-RS resources, and the measurement results corresponding to the N2 second-class CSI-RS resources are each a default value; However, in the analogous art, KANG discloses indexes corresponding to the N2 second-class CSI-RS resources are determined by at least one CSI-RS resource of the N1 first-class CSI-RS resources (KANG, ¶0638, an indicated (or configured) PDCCH/PDSCH beam ID (e.g., a CSI-RS resource or SS block ID [and] ¶0639 when CRI (or SS block ID)=X /”N1 first class”, wherein the CRI is indicated (or reported by a UE) as a PDCCH/PDSCH (candidate) beam, CSI-RS resource indexes (or SS block IDs) subject to TRS rate matching/”N2 second class” may be configured or may be predefined by a rule), or indexes corresponding to the N2 second-class CSI-RS resources are determined by at least one CSI-RS resource of the plurality of CSI-RS resources other than the N1 first-class CSI-RS resources, and the measurement results corresponding to the N2 second-class CSI-RS resources are each a default value ; wherein N1 and N2 are each a positive integer, and N1+N2=N. (SHIN, FIG. TBD, ¶TBD, mapping). Therefore, it would have been obvious to one of the ordinary skill in the art before the effective filling date of the claimed invention to combine SHIN’s apparatus and a method for a side link beam operation in a wireless communication system with KANG’s apparatus and method for transmitting and receiving a channel state information (CSI)-reference signal (RS) The motivation would be to precisely perform time/frequency tracking of a user equipment (UE). [KANG, ¶0029]. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. GO et al. (US 20240204953 A1): Abstract, a method for transmitting channel state information (CSI) a; FIG. 16-18; N1 resources are received and measured CSI-RSs. VENUGOPAL (US20200044720 A1): Abstract; ¶0002, techniques and apparatuses for facilitating uplink beam selection for a UE; FIG. 9; ¶0094-0098; measuring multiple beams and selecting a beam having “a threshold rank relative to other uplink beams”; ¶0104, threshold delays.
