Office Action

§102 §Other
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1-7,9,10,14-17, and 20 are rejected under 35 U.S.C. 102a1 as being anticipated by Poppinga et al. (US 2008/0217886 A1). With respect to claims 1-5, Poppinga et al. discloses a folding handcart comprising a collapsible chassis or frame 11, 14 and retractable ends 2 and 31, said chassis further having side frame 12 and 13 that are hinged at two separate locations 4, as shown in figure 1. PNG media_image1.png 449 767 media_image1.png Greyscale With respect to claims 6 and 7, said side frames form a pair of quadrilaterals with four pivoting mounted members of hinges, that never cross when folded, as shown in figures 1 and 2. With respect to claim 9, said hinges 4 are pivotally rotating elbows, as shown in figure 2. With respect to claims 14 and 15, front and back frames 4 and 31 come together when the frame is collapsed, as shown in figure 2. PNG media_image2.png 518 553 media_image2.png Greyscale With respect to claim 16, the handcart appears to fold if lifted from the center, as shown in figure 3. PNG media_image3.png 485 737 media_image3.png Greyscale With respect to claim 17, the quadrilateral frames have pivots or hinges on each end, as shown in figure 2. With respect to claim 20, front and back wheels overlap when folded, as shown in figure 2. Allowable Subject Matter Claims 8, 11-13, 18 and 19 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
