DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Election/Restrictions Applicant’s election without traverse of Group I, corresponding to claims 1 – 8 in the reply filed on 05/13/2026 is acknowledged. Claims 9 – 20 are withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to a nonelected invention, there being no allowable generic or linking claim. Claims 1 – 8 are under examination. Nucleotide and/or Amino Acid Sequence Disclosures REQUIREMENTS FOR PATENT APPLICATIONS CONTAINING NUCLEOTIDE AND/OR AMINO ACID SEQUENCE DISCLOSURES Items 1) and 2) provide general guidance related to requirements for sequence disclosures. 37 CFR 1.821(c) requires that patent applications which contain disclosures of nucleotide and/or amino acid sequences that fall within the definitions of 37 CFR 1.821(a) must contain a "Sequence Listing," as a separate part of the disclosure, which presents the nucleotide and/or amino acid sequences and associated information using the symbols and format in accordance with the requirements of 37 CFR 1.821 - 1.825. This "Sequence Listing" part of the disclosure may be submitted: In accordance with 37 CFR 1.821(c)(1) via the USPTO patent electronic filing system (see Section I.1 of the Legal Framework for Patent Electronic System (https://www.uspto.gov/PatentLegalFramework), hereinafter "Legal Framework") as an ASCII text file, together with an incorporation-by-reference of the material in the ASCII text file in a separate paragraph of the specification as required by 37 CFR 1.823(b)(1) identifying: the name of the ASCII text file; ii) the date of creation; and iii) the size of the ASCII text file in bytes; In accordance with 37 CFR 1.821(c)(1) on read-only optical disc(s) as permitted by 37 CFR 1.52(e)(1)(ii), labeled according to 37 CFR 1.52(e)(5), with an incorporation-by-reference of the material in the ASCII text file according to 37 CFR 1.52(e)(8) and 37 CFR 1.823(b)(1) in a separate paragraph of the specification identifying: the name of the ASCII text file; the date of creation; and the size of the ASCII text file in bytes; In accordance with 37 CFR 1.821(c)(2) via the USPTO patent electronic filing system as a PDF file (not recommended); or In accordance with 37 CFR 1.821(c)(3) on physical sheets of paper (not recommended). When a “Sequence Listing” has been submitted as a PDF file as in 1(c) above (37 CFR 1.821(c)(2)) or on physical sheets of paper as in 1(d) above (37 CFR 1.821(c)(3)), 37 CFR 1.821(e)(1) requires a computer readable form (CRF) of the “Sequence Listing” in accordance with the requirements of 37 CFR 1.824. If the "Sequence Listing" required by 37 CFR 1.821(c) is filed via the USPTO patent electronic filing system as a PDF, then 37 CFR 1.821(e)(1)(ii) or 1.821(e)(2)(ii) requires submission of a statement that the "Sequence Listing" content of the PDF copy and the CRF copy (the ASCII text file copy) are identical. If the "Sequence Listing" required by 37 CFR 1.821(c) is filed on paper or read-only optical disc, then 37 CFR 1.821(e)(1)(ii) or 1.821(e)(2)(ii) requires submission of a statement that the "Sequence Listing" content of the paper or read-only optical disc copy and the CRF are identical. Specific deficiencies and the required response to this Office Action are as follows: Specific deficiency - The Incorporation by Reference paragraph required by 37 CFR 1.821(c)(1) is missing or incomplete. See item 1) a) or 1) b) above. The file must be submitted in bytes not kilobytes. Required response – Applicant must provide: A substitute specification in compliance with 37 CFR 1.52, 1.121(b)(3) and 1.125 inserting the required incorporation-by-reference paragraph, consisting of: A copy of the previously-submitted specification, with deletions shown with strikethrough or brackets and insertions shown with underlining (marked-up version); A copy of the amended specification without markings (clean version); and A statement that the substitute specification contains no new matter. Claim Interpretation The broadest reasonable interpretation of claim 1 includes at least one plasmid expressing at least one cDNA sequence of the ten genomic segments of TiLV, including all 10 segments within multiple copies, i.e., a plurality, a singular plasmid. Claim 1 can also be interpreted as at least ten different plasmids each encoding a singular genomic segment of TiLV. For purposes of examination, claim 1 is interpreted to include embodiments comprising ten different plasmids each with a single genomic segment of TiLV as depicted in Figure 2, as this interpretation aligns with the Specification and Drawings. Claim Rejections - 35 USC § 112 – Written Description The following is a quotation of the first paragraph of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112: The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention. Claims 3 and 4 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. The written description requirement for a claimed genus may be satisfied through sufficient description of a representative number of species by actual reduction to practice, reduction to drawings, or by disclosure of relevant, identifying characteristics, i.e., structure or other physical and/or chemical properties, by functional characteristics coupled with a known or disclosed correlation between function and structure, or by a combination of such identifying characteristics, sufficient to show the inventor was in possession of the claimed genus. See, e.g., Ariad Pharm., Inc. v. Eli Lilly & Co., 598 F.3d 1336, 1340, 94 USPQ2d 1161, 1167 (Fed. Cir. 2010); University of California v. Eli Lilly & Co., 119 F.3d 1559, 43 USPQ2d 1398 (Fed. Cir. 1997) at 1406; Juno Therapeutics, Inc. v. Kite Pharma, Inc., 10 F.4th 1330, 1337, 2021 USPQ2d 893 (Fed. Cir. 2021) ("[T]he written description must lead a person of ordinary skill in the art to understand that the inventor possessed the entire scope of the claimed invention. Ariad, 598 F.3d at 1353–54 ('[T]he purpose of the written description requirement is to ensure that the scope of the right to exclude, as set forth in the claims, does not overreach the scope of the inventor's contribution to the field of art as described in the patent specification.' (internal quotation marks omitted)."). A “representative number of species” means that the species which are adequately described are representative of the entire genus. Thus, when there is substantial variation within the genus, one must describe a sufficient variety of species to reflect the variation within the genus. See AbbVie Deutschland GmbH & Co., KG v. Janssen Biotech, Inc., 759 F.3d 1285, 1300, 111 USPQ2d 1780, 1790 (Fed. Cir. 2014). The issue is whether the skilled artisan would understand inventor to have invented, and been in possession of, the invention as claimed. The Federal Circuit has clarified the application of the written description requirement to inventions in the field of biotechnology. See University of California v. Eli Lilly and Co., 119 F.3d 1559, 1568,43 USPQ2d l398, 1406 (Fed. Cir. 1997). The Court stated that a written description of an invention requires a precise definition, one that defines the structural features of the chemical genus that distinguishes it from other chemical structures. A definition by function does not suffice to define the genus because it is only an indication of what the genus does, rather than what it is. Further, the Court held that to adequately describe a claimed genus, an applicant must describe a representative number of species of the claimed genus, and that one of skill in the art should be able to “visualize or recognize the identity of the members of the genus.” Instant claims 3 and 4 broadly encompasses cDNA genomic segments of TiLV having at least 90% sequence identity to SEQ ID NO: 1 – 10 or to SEQ ID NO: 11 – 20, respectively. The Specification has failed to sufficiently describe the structural features that must be retained by members of the claimed genus as to establish a structure-function relationship with respect to successful expression of TiLV activity, i.e. producing TiLV capable of infecting and replicating within a cell. Regarding claim 3 and 4, the length of the smallest nucleic acid in SEQ ID NOs: 1 – 20 ais 465 nucleic acids in length (SEQ ID NOs: 10 and 20). A variant sharing only 90% identity to SEQ ID NO: 10 or 20 can have anywhere from 1 to 47 substitutions, deletions or additions in any combination along any length of the sequence. Thus, just for substitutions with canonical nucleic acids alone, the instant claims encompass an enormous genus (447 = 1.98 x 1028) comprising trillions upon trillions of sequences for the smallest nucleic acid sequences without accounting for the prohibitively large number of sequences encompassed by the other sequences. While the instant claims are drawn to a genus that comprises innumerable permutations of sequences, the Specification has only adequately described and successfully reduced to practice only the exact sequences listed in SEQ ID NO: 1 – 20 disclosed in the sequence listing and in the drawings (Figures 2, Specification ¶82, 104). As such, the Specification reasonably demonstrates that Applicant was in possession of variants having only the exact sequence identity to SEQ ID NO: 1 – 20. However, this is not representative of the extremely large genus of sequences claimed, since there is no evidence of the innumerable sequences contained within a genus of sequences having only 90% identical to SEQ ID NO: 1 – 20 that would function to produce TiLV capable of infecting and replicating within a cell. The data generated for the select variants of the TiLV segments described in the Specification and Drawings cannot reasonably be extrapolated and applied to support possession of the entire claimed genus of variants thereof because there are no indications that the genus of sequences having at least 90% identity to SEQ ID NO: 1 – 20, which includes innumerable permutations, would function to produce TiLV capable of infecting and replicating within a cell nor is there a sufficient description of the structure that must be retained for functional characteristics. As in Ariad, merely drawing a fence around the outer limits of a purported genus is not an adequate substitute for describing a variety of materials constituting the genus and showing that one has invented a genus and not just a species. “A patent is not a hunting license. It is not a reward for the search, but compensation for its successful conclusion.” Brenner v. Manson, 383 U.S. 519, 536 (1966). At best, the Specification contemplates the use of BLAST to identify functional homologs based on sequence homology. However, this is not sufficient to describe members of the claimed genus because such methods access online databases that are continually being updated as sequencing technology improves. As a result, they are not a static source of information. Thus, one of skill in the art would readily appreciate that relying on a non-patent source that is continuously subject to change as a means to identify members of the claimed genus does not sufficiently meet the written description requirement. Vignuzzi et al (Nat Microbiol, 2019, hereinafter, “Vignuzzi”) evidences that universality and diversity of defective viral genomes and the predicted role of mutations in viral fitness (Abstract). Vignuzzi evidences that “point mutations in RNA viruses can result in detrimental alterations because of the highly constrained nature of their genome organization” and that “a majority of randomly introduced mutations are either lethal or confer a significant fitness cost.” Furthermore, Vignuzzi evidences that detrimental point mutations in different regions of the viral genome can result in widely varying effects from losing the ability from assembling properly, replicating to integrating into the host DNA (Section: Point mutations, hypermutations and frame shifts). The Specification fails to describe any substantive structural limitations as to establish a structure-function relationship with respect to infection of cells let alone the expression of genes within target cells. Thus, one of skill in the art would readily appreciate that single point mutations, truncations, or rearrangements resulting in 90% identity homology alone cannot serve as the basis to describe members of the genus that have the recited function. In the absence of a representative number of examples, the Specification must at least describe the structural features that are required for the claimed function, in this case the structure that must be retained to produce TiLV capable of infecting and replicating within a cell as described in claims 3 and 4. However, as discussed above, the Specification fails to describe any substantive structural limitations as to establish a structure-function relationship with respect to genomic segments capable of producing a TiLV capable of infecting and replicating within a cell, let alone the various improved properties required throughout the instant claims. The Specification also fails to describe which regions, domains, etc. of the variant sequences must be retained in order to have a functioning variant of the genomic sequences. Instead, Applicant merely offers a cursory statement that any variant 90% of SEQ ID NO: 1 – 20 will work. Accordingly, the claims as currently written are not adequately described and one of skill in the art would readily appreciate that Applicant was not in possession of the claimed genus at the time of filing. Claim Rejections - 35 USC § 103 The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. Claims 1 and 3 – 7, are rejected under 35 U.S.C. 103 as being unpatentable over Medina et al (J Virological Methods, 2014, hereinafter, “Medina”), in view of Tsofack et al (J Clinical MIcrobiology, 2017, hereinafter, “Tsofack”) and Lipkin et al (US20170360918A1, hereinafter, “Lipkin”), as evidenced by Raksaseri et al (PeerJ, 2023, hereinafter, “Raksaseri”). Medina teaches a plasmid-based reverse genetics system for influenza virus (Abstract). Medina teaches that Vero cells are routinely used for reverse genetics, while showing evidence that a co-cultured system can improve viral yields in reduced time (Introduction ¶4). Medina first establishes that CHOK1 cells can “sustain the growth of influenza.” Next, Medina teaches transfecting 12 different plasmids, each containing a segment of an influenza virus, into co-cultured Vero and CHOK1 cells which results in high titers of virus (Figure 4, Section: 3.6. Rescue of influenza viruses ¶ 3). Using this method, Medina teaches that the use of a co-culture system resulted in a system where Vero cells were able to produce recombinant influenza viruses from cDNA and a CHOK1 cell line was able to amplify virions produced by the Vero cells in a short amount of time (Section: 3.6. Rescue of influenza viruses ¶ 2, Figure 5). Importantly, Medina teaches the motivation of selecting cell lines that match the species dependent components of the virus i.e. cells should be able to be produce the recombinant viruses efficiently (Section: 3.6. Rescue of influenza viruses ¶1, Discussion ¶6). Medina does not teach the reassortment of TiLV nor does Medina teach the co-culturing of Vero cells with E11 cells at 28 degrees Celsius or the sequences of TiLV. However, Tsofack teaches the generation of TiLV in E11 cells (¶3). Tsofack teaches that TiLV grown in E11 cells are viable and can infect cells (Table 1). Tsofack also teaches the conditions which affected TiLV replication including temperature (Figure 1). Specifically, regarding claim 1, Tsofack teaches that E-11 cells can produce high titers of TiLV at 25˚C, which is around 28˚C, and that temperatures higher than 30˚C and lower than 20˚C result in low titers (Section: Temperature-dependent viral growth; Figure 1, reproduced below). Lipkin teaches the characterization of TiLV, an orthomyxovirus, including sequences related to TiLV (Abstract, ¶155). Lipkin also teaches methods of generating TiLV in cell culture using a singular cell line (¶213, 214). Lipkin teaches that the cell lines that can be used to generate TiLV include Vero cells and E11 cells (¶213, 214). Regarding claims 3 and 4, Lipkin teaches at least 90% of SEQ ID NOs: 1-20 (Reproduced below before the conclusion of the office action). Regarding claims 5 and 6, Lipkin teaches 100% sequence identity to SEQ ID NOs: 2, 3, 7, 9, 10, 13, 16, 17, 19, and 20. Lipkin teaches a 99.9% match to SEQ ID NOs: 1, 4, 11, and 14. Lipkin teaches a 99.8% match for SEQ ID NOs: 8 and 18, 99.7% match for SEQ ID NO: 15, 99% match for SEQ ID NO: 12, 97.1% match to SEQ ID NO:16, and a 96.6% match to SEQ ID NO 5. These differences between the known sequences and those claimed in the application are patently insignificant and would reasonably constitute common genomic variations within viruses that can be due to stochastic variation and/or technical sequencing errors or artifacts. Absent unexpected results, SEQ ID NOs: 1 – 20 are obvious to those found in prior art and practically insignificant. Regarding claim 7, as evidenced by Raksaseri, E11 cells are derived from Channa striatus. Raksaseri evidences the growth of TiLV in E11 cells evidences mechanisms of mitochondria dysfunction by TiLV in E11 cells (Abstract). Medina, Tsofack, and Lipkin are considered to be analogous to the claim invention because they aim to identify mechanisms of viral infection and production. Medina teaches that the use of a co-culture system resulted in a system where Vero cells produce the orthomyxovirus, influenza, from cDNA and a CHOK1 cells amplify virions produced by the Vero cells in a short amount of time (Section: 3.6. Rescue of influenza viruses ¶ 2, Figure 5). Tsofack teaches that E-11 cells can produce high titers of TiLV at 25 degrees Celsius (Section: Temperature-dependent viral growth; Figure 1, reproduced below). Lipkin teaches methods of generating TiLV, an orthomyxovirus, in cell culture using cell lines such as Vero cells and E11 cells (¶213, 214). Together, the prior art teaches that reverse genetics systems for influenza viruses, which are orthomyxovirus, are well-established. As TiLV is an orthomyxovirus, it would have been prima facie obvious before the effective filing date of the claimed invention to adapt the methods used for the generation of influenza viruses for TiLV because doing so would enable a detailed study of the TiLV genome as well as the production of vaccines directed towards TiLV infection. It would be obvious to 1) use a plurality of expression plasmids expressing TiLV genomic segments as is routinely done for influenza, 2) introduce the plasmids in a co-culture of Vero cells and E11 cells as E11 cells are known to replicate and amplify TiLV virions and Vero cells are known to produce orthomyxovirus from separate expression plasmids. One of ordinary skill in the art would have had a reasonable expectation of success in using the methods for reverse genetics for influenza viruses using a co-culture of Vero and E11 cells given that reverse genetic systems have been established for orthomyxoviruses and that both Vero and E11 cells are known to be permissive to TiLV. Accordingly, the claimed invention was prima facie obvious to one of ordinary skill in the art at the time of filing especially in the absence of evidence to the contrary. Claim 2 is rejected under 35 U.S.C. 103 as being unpatentable over Medina, Tsofack, and Lipkin as applied to claims 1 and 3 – 7 above, and further in view of Hoffman et al (PNAS, 2000, hereinafter, “Hoffman”). As discussed above, claims 1 and 3 – 7 were rendered prima facie obvious by Medina, Tsofack, and Lipkin. While the references teach a method to perform reverse genetics of TiLV in a co-culture system, the references fail to teach bi-directional expression plasmids which express the genomic RNAs of TiLV. However, Hoffman teaches an eight plasmid DNA transfection system for the rescue of infectious influenza A virus from cloned cDNA (Abstract). Hoffman teaches taking advantage of the orientation of transcription units which “allows the synthesis negative-sense viral RNA and positive-sense mRNA from one viral cDNA template (Abstract, Figure 2 reproduced below). Furthermore, Hoffman teaches the rescue of influenza at high titers using this system in co-cultures cells (Abstract). Medina teaches that the use of a co-culture system resulted in a system where Vero cells produce the orthomyxovirus, influenza, from cDNA and a CHOK1 cells amplify virions produced by the Vero cells in a short amount of time (Section: 3.6. Rescue of influenza viruses ¶ 2, Figure 5). Tsofack teaches that E-11 cells can produce high titers of TiLV at 25˚C (Section: Temperature-dependent viral growth; Figure 1, reproduced below). Lipkin teaches methods of generating TiLV, an orthomyxovirus, in cell culture using cell lines such as Vero cells and E11 cells (¶213, 214). Hoffman teaches an eight plasmid DNA transfection system for the rescue of infectious influenza A virus from cloned bidirectional plasmids (Abstract). Together, the prior art teaches that reverse genetics systems for influenza viruses, which are orthomyxovirus, are well-established. As TiLV is an orthomyxovirus, it would have been prima facie obvious before the effective filing date of the claimed invention to adapt the methods used for the generation of influenza viruses for using bidirectional plasmids of TiLV because doing so would increase the likelihood of studying a complete TiLV virion. One of ordinary skill in the art would have had a reasonable expectation of success in using the methods for reverse genetics for influenza viruses using a co-culture of Vero and E11 cells with bidirectional TiLV plasmids given that reverse genetic systems using bidirectional plasmids have been established for orthomyxoviruses and that both Vero and E11 cells are known to be permissive to TiLV. Accordingly, the claimed invention was prima facie obvious to one of ordinary skill in the art at the time of filing especially in the absence of evidence to the contrary. Claim 8 is rejected under 35 U.S.C. 103 as being unpatentable over Medina, Tsofack, and Lipkin as applied to claims 1 and 3 – 7 above, and further in view of Peng et al (Viruses, 2023, hereinafter, “Peng”). As discussed above, claims 1 and 3 – 7 were rendered prima facie obvious by Medina, Tsofack, and Lipkin. While the references teach a method to perform reverse genetics of TiLV in a co-culture system, the references fail to the use of the E6 variety of Vero cells. However, Peng teaches the transcriptomic profiling of Vero E6 cells during a Porcine epidemic diarrhea virus (Abstract). Peng also teaches the Vero E6 cells can be infected with multiple kinds of viruses (Abstract). Peng teaches that “Vero E6 cells are particularly well-suited cell models for studying the pathogenesis of viruses and are commonly used to produce vaccines.” Medina, Tsofack, Lipkin, and Peng are considered to be analogous to the claim invention because they aim to identify mechanisms of viral infection and production. Medina teaches that the use of a co-culture system resulted in a system where Vero cells produce the orthomyxovirus, influenza, from cDNA and a CHOK1 cells amplify virions produced by the Vero cells in a short amount of time (Section: 3.6. Rescue of influenza viruses ¶ 2, Figure 5). Tsofack teaches that E-11 cells can produce high titers of TiLV at 25 degrees Celsius (Section: Temperature-dependent viral growth; Figure 1, reproduced below). Lipkin teaches methods of generating TiLV, an orthomyxovirus, in cell culture using cell lines such as Vero cells and E11 cells (¶213, 214). Peng teaches that “Vero E6 cells are particularly well-suited cell models for studying the pathogenesis of viruses and are commonly used to produce vaccines.” Together, the prior art teaches that reverse genetics systems for influenza viruses, which are orthomyxovirus, are well-established. As TiLV is an orthomyxovirus, it would have been prima facie obvious before the effective filing date of the claimed invention to adapt the methods used for the generation of influenza viruses for TiLV in Vero E6 and E11 cells because both cell lines have been established as useful for studying viral mechanisms and vaccine production. One of ordinary skill in the art would have had a reasonable expectation of success in using the methods for reverse genetics for influenza viruses using a co-culture of Vero E6 and E11 cells with TiLV plasmids given that use of these cell lines is well known, has been successfully demonstrated, and commonly used in the prior art. Accordingly, the claimed invention was prima facie obvious to one of ordinary skill in the art at the time of filing especially in the absence of evidence to the contrary.
