Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Information Disclosure Statement An IDS was filed 0n 05/032024. Specification The abstract of the disclosure is objected to because it is not commensurate in scope with the claims. A corrected abstract of the disclosure is required and must be presented on a separate sheet, apart from any other text. See MPEP § 608.01(b). The title of the invention is not descriptive. A new title is required that is clearly indicative of the invention to which the claims are directed. In specific, it is not directed to the inkjet cartridge being claimed. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim 17 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. The Markush Group of claim 17 is indefinite in that metal oxide is also a pigment. Therefore, the metes and bound of the claimed Markush Group are indefinite. Clarification is requested. Allowable Subject Matter Claims 1-16, and 18-19 are allowed. Conclusion WO 2019152760 A1 (Proctor & Gamble) is cited as a patent of interest for its disclosure of an inkjet cartridge for cosmetic ink. Note that the publication date does not meet the priority date of the instant application.
