DETAILED ACTION
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
Specification
The disclosure is objected to because of the following informalities: The Specification filed 08/16/23 recites the structures on the following pages: 31, 112, 113, and 115-120 which are all graphically unclear due to their low resolutions and faded lines. They all need to be replaced by structures which are clearly legible, with all bonds and atoms that are clearly drawn (i.e., with solid lines).
Appropriate correction is required.
Claim Objections
4. Claim 5 is objected to because of the following informalities: the claim recites structures which are all graphically unclear due to their low resolutions and faded lines. They all need to be replaced by structures which are clearly legible, with all bonds and atoms that are clearly drawn (i.e., with solid lines).
Appropriate correction is required.
Claim Rejections - 35 USC § 112
5. The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
6. Claims 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1, which the other claims are dependent upon, and Claim 5 recites variables Rcc, Rdd, Ree, Rff, Rgg, Rhh, Rii, and Rjj which are nowhere defined (except being “linked to each other to form a ring structure”). The Office has interpreted the variables to correspond to any arbitrary atom or chemical group for the purpose of this Examination.
Correction is required.
7. Claim 6 is rejected under 35 U.S.C.
The claim, which is dependent on Claim 6, recite “an electron withdrawing group represented by Ar3”; however, this “Ar3” (which is clearly a distinct chemical group than that of the Ar3 found in the -C(R1)=Ar3 portion shown in Chemical Formula I) is nowhere defined. The Office has interpreted the Ar3 as recited in Claim 6 to be equivalent in scope to that of the Ar3 as defined in Claim 1 for the purpose of this Examination.
Correction is required.
8. Claim 9 is rejected under 35 U.S.C.
The claim variables Rbb, Rcc, Rdd, and Ree which are nowhere defined (except being “linked to each other to provide a ring structure”). The Office has interpreted the variables to correspond to any arbitrary atom or chemical group for the purpose of this Examination.
Correction is required.
