The following is a quotation of 35 U.S.C. 112 (pre-AIA), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. 07-34-01 Claims 8-16 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Regarding claim 8, line 1 recited “A method, comprising”, is not clear what specific communication device that performs the method. Claim 8, line 4 recited “instructing, in a first super frame, a first synchronized wireless device in the WBMS to transmit a synchronization frame on a first channel”. It is not clear what communication device performs this function. Claim 8, line 6 recited “receiving in a second super frame after the first super frame, an uplink from an unsynchronized wireless device”. It is not clear what communication device performs this function. Claim 9 recited “instructing, in the first super frame, a second synchronized wireless device in the WBMS to transmit the synchronization frame on a second channel”. It is not clear what communication device performs this function. Claim 10 recited “instructing, in the first super frame, a third synchronized wireless device in the WBMS to transmit the synchronization frame on a third channel”. It is not clear what communication device performs this function. Claim 16 recited “instructing, in the first super frame, the first synchronized wireless device to wait a predetermined number of super frames before transmitting the synchronization frame.” It is not clear what communication device performs this function. Allowable Subject Matter 07-43-01 AIA Claim s 8-16 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), 2nd paragraph, set forth in this Office action. Claims 17-24 are allowed over prior art made of record.
