Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1-7 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Sasaki (PG Pub 20150364674). Considering claim 1, Sasaki (Figure 2A) teaches a piezoelectric film comprising: a piezoelectric layer (12 + paragraph 0099) consisting of a polymer based piezoelectric composite material that contains piezoelectric particles in a matrix (18 + paragraph 0099) containing a polymer material (20 + paragraph 0099); electrode layers (14 + paragraph 0099) formed on both surfaces of the piezoelectric layer wherein the piezoelectric particles observed in a cross section of the piezoelectric layer in a thickness direction have a circularity of 0.65 to 0.92 (paragraph 0067 + (4*pi*r^2)/((4*r)^2) wherein r = 0.5 microns leads to 0.785). Considering claim 2, Sasaki (Figure 2A) teaches wherein the piezoelectric particles have an average particle diameter of 0.5 to 5 microns (paragraph 0067). Considering claim 3, Sasaki (Figure 2A) teaches wherein the piezoelectric particles have a circularity of 0.73 to 0.89 (paragraph 0067 + (4*pi*r^2)/((4*r)^2) wherein r = 0.5 microns leads to 0.785). Considering claim 4, Sasaki (Figure 2C) teaches a laminated piezoelectric element formed by laminating a plurality of layers of the piezoelectric film (paragraph 0110). Considering claim 5, Sasaki (Figure 2A) teaches wherein the piezoelectric particles have a circularity of 0.73 to 0.89 (paragraph 0067 + (4*pi*r^2)/((4*r)^2) wherein r = 0.5 microns leads to 0.785). Considering claim 6, Sasaki (Figure 2C) teaches a laminated piezoelectric element formed by laminating a plurality of layers of the piezoelectric film (paragraph 0110). Considering claim 7, Sasaki (Figure 2C) teaches a laminated piezoelectric element formed by laminating a plurality of layers of the piezoelectric film (paragraph 0110).
