Office Action

§101 §102 §103
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Drawings Figs. 4-7 of the drawings are objected to because they are in grayscale rather than in black and white. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Rejections - 35 USC § 101 35 U.S.C. 101 reads as follows: Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title. Claims 1-10 are rejected under 35 U.S.C. 101 because the claimed invention is directed to a judicial exception (i.e., a law of nature, a natural phenomenon, or an abstract idea) without significantly more. Step 1: Claims 1-10 are directed to statutory categories, namely a process (claims 1-10). Step 2A, Prong 1: Claim 1, in part, recites the following abstract idea: …A method implemented by … team display contests and quantifying social media popularity, wherein…, the method comprising the steps of: receiving, … a team participation request from multiple … for joining a display team, the team participation request being transmitted via…; in response to the team participation request, importing…, multiple … associated with the multiple user accounts of… designating … as multiple showpieces, and storing information pertaining to the showpieces’ participation in the display team in …; providing, … to present the showpiece and/or the display team within a display theme, wherein … records a social media interaction behavior data for each showpiece and/or the display team; transmitting, … the social media interaction behavior data to …; receiving, by …, the social media interaction behavior data, calculating a showpiece social media popularity for each showpiece and/or a display team social media popularity for each display theme based on the quality differences among different social media interactions; transmitting, by…, the showpiece social media popularity and/or the display team social media popularity back to…; and storing, …, the showpiece social media popularity and/or the display team social media popularity in the database [Claim 1]. These concepts are not meaningfully different than the following concepts identified by the MPEP: Concepts relating to certain methods of organizing human activity. The aforementioned limitations describe steps for managing personal behavior or relationships or interactions between people, including social activities, teaching, and following rules or instructions. Specifically, designating digital content as showpieces and calculating the popularity thereof is considered to be steps for managing interactions between people. As such, claim 1 recites concepts identified as abstract ideas. The dependent claims recite limitations relative to the independent claims, including, for example: calculating, by …, a showpiece leaderboard, a user leaderboard, and a display team leaderboard based on the display theme. [Claim 2], providing… a showpiece management interface to receive a showpiece management request issued by a manager account, and adjusting the showpiece participating within the display theme based on the showpiece management request [Claim 3], providing… to receive an exchange request issued by a manager account, sending a notification message to the user device associated with the manager account of another display team based on the exchange request, receiving an agreement to the exchange request from the user device associated with the manager account of another display team, and executing the exchange of the showpiece and/or the user account. [Claim 4]. The limitations of these dependent claims are merely narrowing the abstract idea identified in the independent claims, and thus, the dependent claims also recite abstract ideas. Step 2A, Prong 2: This judicial exception is not integrated into a practical application. In particular, claim 1 only recites the following additional elements – a display system for hosting digital content… the display system comprises a display server and a user big data server… by the display server… user devices… a team planning/selection interface…; … by the display server… digital content… the user devices… the digital contents… a database; …by the display server, a display interface… the display interface…; … by the display server… the user big data server; … the user big data server…; … the user big data server… the display server; …by the display server… the database [Claim 1]. The dependent claims recite the following new additional elements – an exchange management interface… [Claim 4]. The servers, user devices, and interfaces are recited at a high-level of generality (see MPEP § 2106.05(a)), like the following MPEP example: iii. Gathering and analyzing information using conventional techniques and displaying the result, TLI Communications, 823 F.3d at 612-13, 118 USPQ2d at 1747-48; Furthermore, the computer implemented element is considered to amount to no more than mere instructions to apply the exception using a generic computer component (see MPEP 2106.05(f)), like the following MPEP example: i. A commonplace business method or mathematical algorithm being applied on a general purpose computer, Alice Corp. Pty. Ltd. V. CLS Bank Int’l, 573 U.S. 208, 223, 110 USPQ2d 1976, 1983 (2014); Gottschalk v. Benson, 409 U.S. 63, 64, 175 USPQ 673, 674 (1972); Versata Dev. Group, Inc. v. SAP Am., Inc., 793 F.3d 1306, 1334, 115 USPQ2d 1681, 1701 (Fed. Cir. 2015); Accordingly, these additional elements do not integrate the abstract idea into a practical application. The remaining dependent claims do not recite any new additional elements, and thus do not integrate the abstract idea into a practical application. Step 2B: Claims 1 and its underlying limitations, steps, features and terms, considered both individually and as a whole, do not include additional elements that are sufficient to amount to significantly more than the judicial exception for the following reasons: a display system for hosting digital content… the display system comprises a display server and a user big data server… by the display server… user devices… a team planning/selection interface…; … by the display server… digital content… the user devices… the digital contents… a database; …by the display server, a display interface… the display interface…; … by the display server… the user big data server; … the user big data server…; … the user big data server… the display server; …by the display server… the database [Claim 1]. These elements do not amount to significantly more than the abstract idea for the reasons discussed in 2A prong 2 with regard to MPEP 2106.05(a) and MPEP 2106.05(f). By the failure of the elements to integrate the abstract idea into a practical application there, the additional elements likewise fail to amount to an inventive concept that is significantly more than an abstract idea here, in Step 2B. As such, both individually or in combination, these limitations do not add significantly more to the judicial exception. The remaining dependent claims do not include additional elements that are sufficient to amount to significantly more than the judicial exception. As discussed above with respect to integration of the abstract idea into a practical application, the dependent claims do not recite any new additional elements other than those mentioned in the independent claims, which amount to no more than mere instructions to apply the exception using a generic computer component (see MPEP 2106.05(f)). As such, these claims are not patent eligible. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claims 1-9 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Talavera (U.S. Publication No 2024/0256346 [hereinafter Talavera] via US-provisional-application 63/436584 (filed 2022-12-31) and US-provisional-application 63/461313 (filed 2023-04-23). Regarding Claim 1, Talavera anticipates …A method implemented by a display system for hosting digital content team display contests and quantifying social media popularity, wherein the display system comprises a display server and a user big data server, the method comprising the steps of: receiving, by the display server, a team participation request from multiple user devices for joining a display team, the team participation request being transmitted via a team planning/selection interface (Talavera, ¶ 167, In some embodiments, which may include but not be limited to (e.g., calendar function, timing data, timing function, timing scheduler, etc.) may apply to, which may include but not be limited to (e.g., dating, interface, application, hologram, artificial intelligence, screens, viewable options, hearing options, connection, dating apps, social media functions, internet platforms, internet clicking/selecting parts, etc.)), (Id., ¶ 247, In some embodiments, there may be an option for, which may include but not be limited to (e.g., there may be an option for, which may include but not be limited to (e.g., open-for-friend-model-creator-group-dates, or open for others to join dates, or open for adding on dates, or available for others to add on dates, or open to party dates, or open to group dates, or open for others to join dates, or open for adding on dates, or open for others to add on dates, or open to party dates, or open to group dates, etc.) In some embodiments, which may include but not be limited to (e.g., ‘bidder’ or ‘high-value dater, user, person, the person paying, etc.) may choose, which may include but not be limited to (e.g., any group of women, any persons, any models, any users, any humans, etc.) to go on a, which may include but not be limited to (e.g., date, connection, time, etc.) with as a, which may include but not be limited to (e.g., ‘package deal’ or multiple users, or multiple creators, or multiple models, etc.) In some embodiments, the, which may include but not be limited to (e.g., ‘creators’ or ‘models,’ etc.) have to all each individually, which may include but not be limited to (e.g., ‘agree,’ accept, want, approve, etc.) on their, which may include but not be limited to (e.g., interface, profile/settings/etc.) with the, which may include but not be limited to (e.g., platform, 3rd party, settings, persons, users, etc.) that the ‘model’ is, which may include but not be limited to (e.g., ‘available,’ open, willing, confirming, wanting, open to, etc.) a, which may include but not be limited to (e.g., ‘open group dates with other, additional group dates, dates with others, connections with other users, models, persons, etc.) which may include but not be limited to (e.g., friend, another model, another creator, another user, etc.) On the platform, user interface, etc.) which may include but not be limited to (e.g., ‘open for model-group dates’ or open for multiple users, open for multiple group dates, etc.) may suggest, which may include but not be limited to (e.g., humans, users, persons, 3rd party, artificial intelligence or other means in the area of suggestion, etc.) for ‘group dates’ next to her, which may include but not be limited to (e.g., picture, pictures of other ‘potential group date options, profile, suggestions, etc.) In some embodiments, options may be chosen by, including but not limited to (e.g., computing operation, user, artificial intelligence, etc.) to suggest potential ‘group packages’ to the potential ‘bidder, fan, subscriber, etc.) In some embodiments, high-value dater (high-value dater may be defined as any person spending money or using a platform) In some embodiments, a ‘paying person’ may have the option to choose any group of users to go on a date/connection with as a package/or grouped deal paid for separately or at one time or paid each or paid together. First, Talavera discloses counts of social media interaction behavior (Talavera, ¶ 88, In some embodiments, which may include but not limited to (e.g., leader board, displayed special members, top ranking, top selling, top marketing, particular persons, etc.) of, which may include but not limited to (e.g., ‘model/creators’, users, persons, entities, 3rd parties, advertisers, advertisements, businesses, etc.) on which may include but not limited to (e.g., platform, interface, etc.) may show which may have but not limited to (e.g., not the exact amount spent, but may be an extensive range, may be a range of amount, may be a range of rankings, etc.) In some embodiments, the, which may include but not limited to (e.g., list, section category, area, interface, badges, verifications, etc.) which may show which may have but not limited to (e.g., creators, models, persons, users, etc.) which may include but not limited to (e.g., popularity, effort, time spent, logins, availability, total earnings, which may be associated with ranges, most popular, most paid, highly paid, highly suggested, etc.) These may include but are not limited to (e.g. large amounts, large monthly amounts, daily large amounts, daily sales, weekly sales, yearly sales, etc.) On the, which may include but is not limited to (e.g., platform, through 3rd party integrations, on interfaces, etc.) In some embodiments, alternatively, the, which may include but not limited to (e.g., leaderboard, area, interface, section, category, list, etc.), may show the, which may include but not limited to (e.g., highest average earning per date, for creators that have been on at least a certain number of dates, models that have reached a certain amount of money earned, highly ranked, highly interacted with, the amount earned, amount donated, donations, charity, etc.)). Further, Mao discloses a personalized behavior evaluation weight as well as a current platform behavior weight (Mao, column 35, lines 17-40, Form a score/metric representing the expertise weighted ability of a potential influencer to influencer others, and rank each potential influencer based on their expertise and ability to influence others; Identify the top N ranked potential influencers as “top” influencers whose content will be subject to further analysis; For each of the identified top influencers, determine the sentiment expressed by each of their relevant posts, comments, or advice; This may include training a machine learning model to classify an input statement or group of statements with regards to whether they exhibit a positive or negative sentiment regarding an item, topic, entity, or event; For each top influencer, determine a measure of the historical accuracy of that person's comments or posts; In some embodiments, this may be dependent upon a timeframe, that is, a person's comments or posts may be more accurate with regards to short or near-term behavior compared to medium or longer-term behavior), (Id., column 35, line 40 – column 36- line 15) Generate an index or measure of the current confidence in the behavior of the stock, company, trend, etc. for each top influencer by forming an accuracy weighted sentiment value for each relevant comment or post and combining those; For example, this may be an averaged or normalized sum of terms, where each term is a product of an accuracy measure (during a relevant timeframe) and a sentiment measure (for a comment or post during the same timeframe or relevant to that timeframe); If sufficient or reliable enough accuracy related data is not available, then instead, the measure of the expertise weighted ability of a person to influence others may be used to weight the sentiment or a sum of sentiment values; Note that the level of expertise and ability to influence others are likely connected (as it is assumed that a demonstrated expertise will enhance someone's ability to influence others) but together represent a way of approximating the weight to be given their opinion or advice as expressed in a positive or negative sentiment; Generate an overall influencers' confidence index by forming a combination of each top influencer's current confidence index, where the overall index represents the overall confidence a set of (top) influencers have in the behavior of the company, industry, trend, fashion, item, automobile, etc.; and Generate a user interface or display enabling a user to view and interact with one or more of In some embodiments, the user interface or display may comprise the overall influencer confidence index trend for the specific example aspect or topic at different scales; In some embodiments, the user interface or display may comprise the trending topics of posts or comments in a word cloud format; In some embodiments, the user interface or display may comprise a list of the top influencers as ranked by user selectable criteria; In some embodiments, the user interface or display may comprise a list of the top messages ranked by the popularity of the messages or other criteria). It would have been obvious to one of ordinary skill in the art at the time of the invention to have calculated a personalized behavior evaluation weight and a current platform behavior weight as in the improvement discussed in Mao in the system executing the method of Talavera. As in Mao, it is within the capabilities of one of ordinary skill in the art to measure the popularity of social media content through the use of quantified interaction data as demonstrated by Talavera with the predicted result of accurate popularity calculations with consideration of personal and platform behaviors. Thus, through KSR Rationale C (See MPEP 2141(III)(C)), the combination of Talavera and Mao discloses …wherein the showpiece social media popularity is generated according to the following calculation formula: showpiece social media popularity = (counts of the social media interaction behavior) * (personalized behavior evaluation weight) * (current platform behavior weight). Mao further discloses …the personalized behavior evaluation weight is assessed based on the historical behaviors of the user account by the user big data server (Mao, column 35, lines 17-40, Form a score/metric representing the expertise weighted ability of a potential influencer to influencer others, and rank each potential influencer based on their expertise and ability to influence others; Identify the top N ranked potential influencers as “top” influencers whose content will be subject to further analysis; For each of the identified top influencers, determine the sentiment expressed by each of their relevant posts, comments, or advice; This may include training a machine learning model to classify an input statement or group of statements with regards to whether they exhibit a positive or negative sentiment regarding an item, topic, entity, or event; For each top influencer, determine a measure of the historical accuracy of that person's comments or posts; In some embodiments, this may be dependent upon a timeframe, that is, a person's comments or posts may be more accurate with regards to short or near-term behavior compared to medium or longer-term behavior); the current platform behavior weight is assessed based on the statistical behaviors of the display theme by the user big data server (Id., column 35, line 40 – column 36- line 15) Generate an index or measure of the current confidence in the behavior of the stock, company, trend, etc. for each top influencer by forming an accuracy weighted sentiment value for each relevant comment or post and combining those; For example, this may be an averaged or normalized sum of terms, where each term is a product of an accuracy measure (during a relevant timeframe) and a sentiment measure (for a comment or post during the same timeframe or relevant to that timeframe); If sufficient or reliable enough accuracy related data is not available, then instead, the measure of the expertise weighted ability of a person to influence others may be used to weight the sentiment or a sum of sentiment values; Note that the level of expertise and ability to influence others are likely connected (as it is assumed that a demonstrated expertise will enhance someone's ability to influence others) but together represent a way of approximating the weight to be given their opinion or advice as expressed in a positive or negative sentiment; Generate an overall influencers' confidence index by forming a combination of each top influencer's current confidence index, where the overall index represents the overall confidence a set of (top) influencers have in the behavior of the company, industry, trend, fashion, item, automobile, etc.; and Generate a user interface or display enabling a user to view and interact with one or more of In some embodiments, the user interface or display may comprise the overall influencer confidence index trend for the specific example aspect or topic at different scales; In some embodiments, the user interface or display may comprise the trending topics of posts or comments in a word cloud format; In some embodiments, the user interface or display may comprise a list of the top influencers as ranked by user selectable criteria; In some embodiments, the user interface or display may comprise a list of the top messages ranked by the popularity of the messages or other criteria). It would have been obvious to a person of ordinary skill in the art before the effective filing date to have modified the social media interaction count elements of Talavera to include personalized behavior evaluation weight and current platform behavior weight elements of Mao in the analogous art of discovering online influencers and generating market sentiment index. The motivation for doing so would have been to provide an improved method “to identify influencers in the areas of health advice, food, apparel, travel, furnishings, music, popular culture trends, lifestyle, artwork, etc..” wherein … “an influencer's expertise and ability to influence others can be evaluated, their accuracy with regards to being correct in “predicting” a behavior of a trend (or other item), and their sentiment with respect to an item for purchase, a style of music, a fashion or popular culture trend, etc.” (Mao, column 8, lines 55-54), wherein such improvements would benefit Talavera’s method which seeks to provide an improved “platform or page [which] may show (e.g., popular users, users, suggested users, ‘trending creators’ or ‘trending models’, etc.) (e.g., ‘near you or similar or based on AI-generated preferences of each user, general preferences, popularity, same city, same travel schedule, etc.)” [Mao, column 8, lines 55-54; Talavera, ¶ 251].
