Claims 13 and 18 are withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to a nonelected invention. Specification 06-11 AIA The title of the invention is not descriptive. A new title is required that is clearly indicative of the invention to which the claims are directed. Claim Rejections - 35 USC § 102 07-06 AIA 15-10-15 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-08-aia AIA (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 07-15 AIA Claim s 1-12, 14-17, 19 and 20 are rejected under 35 U.S.C. 102( a)(1 ) as being anticipated by NAGATA (WO-2020235383) . Claim 1: Nagata teaches a protective film (i.e. hard coat) (translation copy, paragraph bridging pages 31-32) comprising a polymerizable compound having a hydrogen bond value of 4 or more (translation copy, page 5, second paragraph) and three or more (meth)acryloyl groups in a molecule (translation copy, page 6) with a crosslinkable base value of 5 to 6 (page 9, first four paragraphs) and thus satisfies the claim condition (A). Claims 2 and 3: The protective layer is expected to exhibit an elastic modulus of the claimed range, i.e. 6 GPa or more, and a breaking elongation of the protective layer is 10% or 23% or more because it composed of the same materials (see claim 1 above and compare the materials used to make the protective film in the Examples to the Examples in the instant specification) and having the same thickness (see claim 4 below) Claims 4-6: The thickness of the base film is 100 µm or less (translation copy, page 24, 4 th paragraph). Claims 7-11: Nagata teaches the coating layer containing a polymerized substance and the hydrogen bonding group in the polymerized substance is at least one from a hydroxy group, a urethane group, an amide group, a urea group (translation copy, page 8, 8 th paragraph). Claim 12: The thickness of the protective layer (coating film) is 1 to 25 m m (translation copy, page 25, 5 th paragraph) and thus the thickness range of 1 to 10 m m is anticipated. Claim 14: A scratch-resistant layer is provided on the protective film (hard coat film) (page 25, 7 th - 8 th paragraphs). Claim 15: The scratch resistant layer comprises a polymerized substance of a polymerizable compound which has one or more hydrogen bonding group and three or more (meth)acryloyl groups in a molecule of the polymerizable compound (page 25, last four paragraphs and page 26, first two paragraphs), in which a hydrogen-bonding value is 4 or more and 3 or more (meth)acryloyl groups in a molecule with a crosslinkable base value of 5 to 6 (translation copy, page 32) and thus satisfies the claim condition (A). Claim 16: Nagata teaches a foldable device comprising a a cover window containing glass and a protective layer as discussed in claim 1 above (translation copy, paragraph bridging pages 31-32). Claim 17: The thickness of the cover window is 100 µm or less (translation copy, page 24, 4th paragraph).. Claim 19: The scratch resistant is over the protective film (translation copy, page 31, 4 th paragraph) and thus is provided at a surface opposite to a side at which the cover window is provided. Claim 20: . The scratch resistant layer comprises a polymerized substance of a polymerizable compound which has one or more hydrogen bonding group and three or more (meth)acryloyl groups in a molecule of the polymerizable compound (page 25, last four paragraphs and page 26, first two paragraphs), in which a hydrogen-bonding value is 4 or more and 3 or more (meth)acryloyl groups in a molecule with a crosslinkable base value of 5 to 6 (translation copy, pages 31-32) and thus satisfies the claim condition (A).
