Office Action

§103
DETAILED ACTION The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claims 1-20 as filed on 9/18/2023 are under consideration. Drawings The drawing filed on 09/18/2023 is acceptable subject to correction of the informalities indicated below. In order to avoid abandonment of this application, correction is required in reply to the Office action. The correction will not be held in abeyance. The informality is the following: The single drawing is currently labeled as “FIG. 1”. Per 37 C.F.R. 1.84 (u), “Where only a single view is used in an application to illustrate the claimed invention, it must not be numbered and the abbreviation “FIG.” must not appear.” The drawings are objected to as failing to comply with 37 CFR 1.84(p)(5) because they include the following reference character(s) not mentioned in the description: Numbers 101 to 107. Corrected drawing sheets in compliance with 37 CFR 1.121(d), or amendment to the specification to add the reference character(s) in the description in compliance with 37 CFR 1.121(b) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Specification The disclosure is objected to because of the following informalities: Per 37 CFR 1.84(u)(1), the specification should be amended throughout to refer to “the FIGURE” rather than to “FIG. 1”. (See the original specification at least at par. 19, page 3 as filed, for correction and any other occurrences of a reference to “FIG. 1” that may be present). Appropriate correction is required. Claim Rejections - 35 USC § 103 The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. Claims 1-20 are rejected under 35 U.S.C. 103 as being unpatentable over Kim et al. (WO 2020/085829 A1). Regarding the “organic boron-nitrogen compound” of instant claims 1, 9, and 20, Kim et al. discloses material for a light emitting device including Formula (2) (see abstract and par. 16-21): PNG media_image1.png 204 268 media_image1.png Greyscale . Ring A may be substituted or unsubstituted C6 aryl (see par. 18) per the C6 ring shown in instant Formula (I) core group. Rings B and C may be selected from substituted or unsubstituted C6-C30 aryl or 3 to 50 membered heteroaryl rings (see par. 18). Y1 is B (see par. 19) and each X1 and X2 is independently NR where R may be substituted or unsubstituted C6 aryl (see par. 20-21) per the phenyl rings shown in instant Formula (I) core group. Further regarding B or C rings, aryl is defined to include at least phenyl, naphthyl, or fluorene (see par. 27) and heteroaryl is defined to include at least benzimidazole, dibenzofuran, dibenzothiophene, or carbazole (see par. 28) per instant Ar1 and Ar2 groups of instant Formula (I). With respect to at least one fluorine (F) in an instant Formula (I) compound, Kim et al. teaches “substituted” includes halogen (see par. 31) of which fluorine is a member of a small, finite group. Regarding claims 2-4 and 11-13, per instant Ar1 ring, Kim et al. Formula 2 B or C ring may be at least fluorene (par. 27) or benzocarbazole, carbazole, dibenzothiophene or dibenzofuran (par. 28). Regarding claims 5 and 14, per instant Ar2 ring, Kim et al. Formula 2 B or C ring may be at least phenyl or naphthyl (par. 27) or benzimidazole, benzothiazole, or benzofuranyl (par. 28). Regarding claims 6 and 15, Kim et al. Formula 2 definitions provide for substitution at any location of a substituted aryl group (see par. 18, 27, 31). Regarding claims 7 and 16, substituents may be included as previously discussed and may be selected as the recited number of substituents (see above discussed possibly substituted groups and see par. 31 discuss of substituents). Regarding claims 8 and 17, substituents on Kim et al. aryl or heteroaryl groups are discussed at par. 31. Regarding a device structure of claims 9 and 20, the compounds of Kim Formula 2 are used in a light emitting layer of a device (see par. 231-233 and claims 17 and 18 on page 73). Regarding claim 10, the Kim Formula 2 compound is used with a host material in a light emitting layer (see par. 232). Regarding claims 18 and 19, forming a blue light emitting device is disclosed, which is in the visible color wavelength range (see par. 247, 296). Further regarding claim 20, a light emitting device may part of a display device (see par. 2, 247, 249). While Kim et al. does not appear to show a Formula 2 compound as an example the same as an instant Formula (I) compound, given the teachings of the reference, it would have been obvious to one of ordinary skill in the art before the effective filing date of the instant invention to form compounds of the reference for a light emitting device as described above wherein the resultant compound and device comprising the compound would also meet the limitations of the instant claims. One would expect to achieve functional compounds for an operational light emitting device within the disclosure of Kim et al. with a predictable result and a reasonable expectation of success. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure: Babudri, F., Farinola, G. M., Naso, F., & Ragni, R. (2007).
