The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-4 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
There is insufficient antecedent basis for this limitation in the claim as follows:
Claim 1 recites the limitation "the end" in line 4.
Claim 1 recites the limitation, “the direction” in line 9.
Claim 1 recites the limitation, "the tip" in line 13.
Claim 1 recites the limitation, "the guidance" in line 7 from the end.
Claim 1 recites the limitation, "the gap" in line 5 from the end.
Claim 1 recites the limitation, “the depth” in line 4 from the end.
Claim 2 recites the limitation, “the face” in line 3.
Claim 3 recites the limitation, “insert plate” in line 3. For the purposes of the office action and in view of the originally filed specification, “the insert plate” is considered as “the insert piece” in claim 1.
Claim 3 recites the limitation, “the form” in line 4.
Claim 3 recites the limitation, “the center” in line 4.
Claims 4 are rejected as being dependent on rejected base claim 1.
Appropriate correction is required.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-4 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Li (PGPUB 2020/0133032 A1).
As to claim 1, Li (Figs. 1-3) teaches, an assembly structure (Fig. 1) of temple (temple arm 1) and side shield (shield 3), comprising a temple (temple arm 1), a spectacles frame (i.e. frame 2 as shown in Fig. 5) and a side shield (shield 3), wherein the temple comprises a slot (indent 12) with an opening (i.e. bottom opening of indent 12 as shown in Fig. 1) facing downward is provided at one end (i.e. end of the temple near the rim and spectacle frames) thereof adjacent to the end assembled with the spectacles frame (Fig. 1), two engaging protrusions (protrusions 14) protruding toward each other (Fig. 1), each provided on a pair of corresponding walls (i.e. exterior wall of temple arms and inner wall: i.e. left wall and right wall in the direction of the temple as shown in Fig. 1) of the slot, and a first introduction bevel (i.e. bottom curvature of protrusion 14) provided on each side of the two engaging protrusions facing the opening (Fig. 1), wherein the first introduction bevel is inclined from bottom to top and in a direction in which the engaging protrusions protrude (i.e. bevel is provided along the direction of the temple), wherein the side shield comprises an insert piece (tab 32, which is the entire upper structure protruding from shield 3 as shown in Fig. 1) arranged on the top end thereof (Fig. 1), a through hole (i.e. slot hole that runs horizontally between the lower ribs 35 and upper ribs 37) passing through the wall of the insert piece (Figs. 2 and 3: i.e. protrusions 14 fit into the slot hole as shown in Fig. 3), and two second introduction slopes (i.e. top round edges of upper ribs 37) arranged on both sides of the tip (i.e. top surface of upper ribs 37) of the insert piece (Fig. 3), wherein the second introduction slopes are inclined from top to bottom toward the outside (Fig. 2: i.e. rounded top surface), wherein the insert piece is inserted through the opening (Fig. 3: i.e. tab 3 inserted into the indent 12 of the temple arm) and under the guidance of the first introduction bevels and the second introduction slopes (Fig. 3), the tip of the insert piece smoothly passes through the gap (i.e. opening between two protrusions 14) between the two engaging protrusions (Fig. 2) and further enters the depth of the slot (Fig. 3: i.e. tab 3 is fully inserted), at this time, the two engaging protrusions are correspondingly embedded in the through hole of the insert piece, so that the side shield is stably assembled on the temple (¶ 19: i.e. the space is engaged with the protrusions 14 as shown in Fig. 3).
As to claim 2, Li (Figs. 1-3) teaches, wherein the temple has a through hole (Fig. 1: i.e. temple arm has through hole/opening on inner wall of the temple arm) provided on the wall thereof facing the person's face (Fig. 1) and at a position corresponding to the slot, wherein the through hole is connected with the slot (Fig. 1).
As to claims 3 and 4, Li (Fig. 1) teaches, wherein the through hole on the insert plate that penetrate (i.e. penetrated in horizontal direction as shown in Fig. 2) the wall of the insert plate are also allowed to be designed in the form of grooves (Fig. 1: i.e. the space is also a concave opening, where inner surfaces 34 of upper rib 37 and lower rib 35 are taller than the surface of tab 3’s main base, which runs along the surface of fin extensions 36. In other words, in view of Fig. 2, left/right can be recognized as X-axis, up/down can be recognized as Y-axis, Z axis, which would run perpendicular to both X and Y axes have an opening that is not through hole) that are concave toward the center of the wall of the insert plate on both side surfaces (i.e. left surface on Fig. 1 and right surface, which would be hidden and on other side of left surface in Fig. 1) of the insert plate without penetrating the wall of the insert plate (Fig. 1).
