DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
Priority
Acknowledgment is made of applicant's claim for foreign priority based on an application filed in Korea on December 27, 2022.
Should applicant desire to obtain the benefit of foreign priority under 35 U.S.C. 119(a)-(d) prior to declaration of an interference, a certified English translation of the foreign application must be submitted in reply to this action. 37 CFR 41.154(b) and 41.202(e).
Failure to provide a certified translation may result in no benefit being accorded for the non-English application.
Status of Claims
This action is in reply to the communication filed on December 16, 2023.
Claims 1 – 23 are currently pending and have been examined.
Information Disclosure Statement
The references provided in the Information Disclosure Statement filed on October 16, 2023 have been considered. A signed copy of the corresponding 1449 form has been included with this office action.
Specification
The disclosure is objected to because of the following informalities:
Many of the compounds on pages 12 – 30 and 60 are low resolution and appear to missing all or parts of bonds in the compounds shown. A list of non-comprehensive examples include BQZ11

.
In the synthesis examples, similar resolution issues persist and reactions 1, 6, 11, and 15 in particular are very small, adding to the difficulty in determining the compounds.
Appropriate correction is required.
Claim Objection
Claims 3, 6, 8, 18 and 23 are objected to because of the following informalities:
The claims contain compounds that are similarly low resolution to those cited above in the specification and appear to missing all or parts of bonds in the compounds shown.
Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 4 – 17 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention.
Claim 4 recites an organic light emitting diode including a first red emitting material layer including a compound represented by Formula 1. However, no structure has been provided for Formula 1. This renders the claim indefinite as it is not clear what compounds are represented by Formula 1.
Claims 5 – 17 are rejected as being dependent on claim 4.
For examination purposes, Formula 1 is interpreted as referring to the compound in claim 1.
Examiner recommends either amending claim 4 to depend from claim 1 or amending claim 4 to include the structure of Formula 1.
Allowable Subject Matter
Claims 1 – 3 and 19 – 23 are allowed.
Claim 18 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Claims 4 – 17 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.
The following is a statement of reasons for the indication of allowable subject matter:
CN111808076A is considered pertinent to the claimed invention. The ‘076 application teaches compounds, such as compound 48, which contains the condensed polycyclic group required in claim 1. However, compound 48 and the Formula (1) of the ‘076 application require that the polycyclic group is bonded to a carbazole group in a position corresponding to the R5 position in the claimed Formula, which differs from the claimed Formula which requires R5 to be selected from hydrogen, deuterium, alkyl or aryl groups.
Conclusion
All claims are rejected.
