Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-26 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding claim 1, the claimed limitation, “identifying the transmitter of the transmitted test signal by the at least one receiver of the wireless network on the basis of the preamble of the test signal received by the respective receiver of the wireless network”, have rendered the claim indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Are the at least one receiver of the wireless network and the respective receiver of the wireless network the same or different receiver. Dependent claims 2-22 are rejected for the same reasoning Appropriate correction required.
Regarding claim 1, the claimed limitation, “transmitting a retransmission signal which comprises a preamble and the calculated pre-distortion characteristic of the transmission amplifier of the identified transmitter by the receiver of the wireless network to the identified transmitter of the wireless network; and linearizing the transmission amplifier of the transmitter on the basis of the pre-distortion characteristic of the retransmission signal received by the transmitter of the wireless network from the receiver of the wireless network”, have rendered the claim indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant, regards as the invention. Is the receiver of the wireless network the same as the at least one receiver of the wireless network. Also, it is unclear as to how the receiver transmits a retransmission signal and the transmitter receives the retransmission signal. Dependent claims 2-22 are rejected for the same reasoning. Appropriate correction required.
Claim 1 recites the limitation "the distorted ramp signal". There is insufficient antecedent basis for this limitation in the claim.
Regarding claim 23, the claimed limitation, “a transmitter comprising the transmission amplifier adapted to transmit a test signal amplified by the transmission amplifier to a receiver of at least one other apparatus within the respective wireless network a receiver adapted to receive a retransmission signal from a transmitter of the at one other apparatus of the wireless network”, have rendered the claim indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Is the receiver the same as the receiver of at least one other apparatus. Also, Is the transmitter the same as the transmitter of the at least one other apparatus. Appropriate correction required.
Regarding claim 23, the claimed limitation, “wherein the calculated pre-distortion characteristic is transported within the retransmission signal received by the receiver of the apparatus“, have rendered the claim indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant, regards as the invention. Does the Applicant refer that the transport of the retransmission signal of the calculated pre-distortion between apparatuses . Appropriate correction required.
Regarding claim 24, the claimed limitation, “wherein the calculated pre-distortion characteristic is transported within the retransmission signal received by the receiver of the respective apparatus“, have rendered the claim indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant, regards as the invention. Does the Applicant refer that the transport of the retransmission signal of the calculated pre-distortion between apparatuses. Dependent claims 25-26 are rejected for the same reasoning. Appropriate correction required.
